    Well, I sent off letter one yesterday to ask for refund as I already had two years of statements totalling a terrible £785. I received a form type email from them today to say they are investigating &etc. Will keep you posted. Cannot see why they will be any different to anyone else... I am pursuing HSBC also for a much larger sum. Fingers xxxx
  • Hi this is the first post ever on here, been reading through, but so many posts on here got a bit lost.

    My question is this, I have took Cahoot to court reclaiming charges on Credit Card Account. With all interest piled up it comes to nearly £300o claim. The problem is when I filled out AQ online there was not enough room to say that I wanted the money paid by cheque.

    I don't want Cahoot to pay the money off my credit card £3016, because I hae some other debts as well and am using DMA at the moment costing me £25.00 a month. Started this before realising I could have got things sorted for free. Also Cahoot will cncel my credit card.

    Question is can I phone or write to the judge asking him, to make sure I am paid by cheque?

  • Little confused if the amount you are claiming is circa £3000 but you state that £3016 is "outstanding" on the C.C then all you would only owe cahoot in reality the £16?

    has the defendant indicated that they will attend court? as in reality they likely to settle before the matter is heard.

  • So sorry. I am going to court for £2600 plus interest at 8%. With the interest and the time it has taken it will be nearer £3000. I only have £3016 on my credit card, I am £16 over my limit. Cahoot said they would be defending the case. They have not put in their statements to the court, these were suipposed to be in 14 days before the date, and the court still has not received anything from them and told me to wait.

    Yes once it has all gone through and I win I would owe between £16 and £200. But I do have others I am trying to pay off and would like to spread the payment around as at the moment I am skint. Been off work for 5 weeks and do not have any money to pay any one else, also MOT and Tax due on car.
  • o.k presuming the defendant chooses to settle prior to court they would reconcile the balance on the card to show what is owed minus the charges, court interest and costs. ( i.e total amont claimed)

    they would then issue a cheque for anything owed in excess of this

    so if the sums you have given are correct then they would subtract the £16 and issue you with a cheque for £2984

    However are there any other complicating factors that you have not mentioned, other than the account is obviously still “live”

    They are quite liekl yto offset what they owe you - however insist that any costs you have paid out ie issue fee and AQ fee are paid back to you direct.

  • If they do not show on Friday I am going to plea to the judges better side and see if he can issue an order for the money to be paid by cheque. Not received anything in the post this morning and balance on account is still standing.
  • Just to let you all know I won my case against cahoot. Got a phone call from Inga at 4.45pm today Tues, getting whole lot charges interest and all court costs.

  • I was sending my letters to Cahoot quite merrily, have got to the stage where I need to start a court claim, and my job has ended at the same time! It was a long term temp assignment, but with no immediate cash forthcoming and urgent things to pay for first like council tax and rent, I can't pay any fees right now! I'm a kleeneze distributor and there is an income from that but its half my fiance's and all spare money is going towards keeping debts under control!

    :eek: Any advice out there? I don't want them to think that I've been successfully fobbed off! The 14 days just expired!
