    Hi Kimmie,

Yes they sent a cheque as my acct has been closed a long time now. I ended up with a default from them and my acct was sent to Debt Recovery Agency. Paid that off immediately but still managed to get meself a default!
Doh! (I've learnt my lesson there!)

I went straight to Simply Be as when i signed onto the acct years later i still had a closed balance of £400!! they said this was becos it had been passed on.

HSBC are fools, they defended with 2 days to go, grrrr...initial letter was sent 28th Feb...its dragging on but im looking forward to their defence letter :p then a court date and im hoping a decent offer !

Capital One took ages sending statements, came back with £100 charges so claimed for that and £25 interest..cos im cheeky! Got a letter saying they are looking into it and will have a response shortly, i think they have until end of this week then they get LBA.

Seems like we both use the same nasty companies, lol

....Although of course im not totally blameless!

    Kimmie,

Admin charges ...definitely yes you can claim them back, dont think you can claim service charges..how much roughly are they charging you for Service Charges?

    Thanks Shelley

This is what they look like on my statement:
    23/04/2007 Service Charge N/A N/A N/A N/A FOLLOW 8 2.000% AMOUNT DUE 97.20 £8.51
    26/03/2007 Service Charge N/A N/A N/A N/A FOLLOW 7 2.000% AMOUNT DUE 79.62 £7.88

The % rate seems to differ- do you think this is the credit charge - and therefore I know this is not claimable.

    Thanks

    No probs,

Yeah i think this is just the charge for credit! Therefore unclaimable. Good luck!

    Hi,

Does anyone know whether I can claim admin/late payment charges back from JD Williams even though my account defaulted and went to debt collectors and was paid off with a settlement figure yesterday? The amount I actually owed them was £118, but with charges this went up to £220 and the debt collectors settled for £187 (still £69 over what I actually owed them).

Also, I had a credit card with Capital One, credit limit £200, with charges added it went up to £640 then they knocked £440 off one xmas a while ago, but then it crept up to £332 again. This debt also defaulted and got passed around debt collection agencies, and was also settled yesterday for £265 (again, £65 over what was originally owed).

Finally HSBC - I had an account with them (closed 3+ years ago) but I don't know the account number, or even if I had charges on the account, though I think I did. Would it be worth chasing up since I'll probably only be claiming 2 years of charges?

Can I claim and do you think it would be worth it since I dont have statements so I'd need to spend £10 each getting them anyway?

    Any advice appreciated!

    Thanks,
    Stacie

    Hi

Yes, thanks to my good advisor, Shelley, you can claim your late payment/admin charges back. I too have applied to Simply be for this information.

I also applied to capital one and have put in a claim for my husband and my charges back,,,,, still waiting for response. But please note they do not charge for statements, so just write the standard letter and you will receive them fairly quickly.

I have applied to First Direct as this is who I have my details with, and they are dragging their feet over sending statements.

I would still apply if you have had an account with any financial institution in the last 6 years. You do not need all the account information and usually they can ask a few private details and give you the information. Try calling them first for this and then applying when you have them.
    ##Good luck.

    Stacie,

JD WIlliams have many different catalogue companies, i would advise going to the website which you use to purchase and seeing if there is a contact us option. If so email them and request your statements, mine came within days of mailing them, very prompt.
My account was also sent to DCA and incurred a default, i am going to try and get them to cancel my default next as it is over 4 years old!!

With Cap One, i have sent them the LBA and they have another 7 days to respnd, dont think they will though so will probably end up being the lucky winnner of my fourth claim!

I dont think it makes a difference whether the acc went to default or not as we are claiming because the charge amount is unfair, not because we deny we shouldve got charged.

I think it will be definitely worth it. I have won £181 from JD Williams after 1 letter and a court claim!

Many Thanks :) I have emailed Viva la Diva (in debt over some shoes :o ) to request my statements, I did manage to log in and see a few months worth of charges but I know they go back further, and as soon as a minute I'll give Capital One a call...

    Thanks again,
    Stacie
