And is there a defence I can use when they claim that the charges are fair? Such as OFT842 for banks?
I have tried to search the posts but haven't found anything relevant.
If you are claimant why do you need a defence?0 -
I meant against their claim that the charges are fair and for me to 'go away'.0

Yes they have said this. And no legal grounds given. Letters just say the charges were "outlined in the t&cs and in the monthly statements... The charges are fair and reasonable... There will be no refunds... blah blah".
Can i refer to UTCCR 1999, sch 2(e)? Can't make out if relevant.0 -

I was told before yes you can and then in this post http://forums.moneysavingexpert.com/showthread.html?p=28667069&posted=1#post28667069 I am told no you can't, Which is it?
And as I mentioned on that thread, I asked Fashionworld for the admin fees back, they said no, so what do I do now? This is a system account and does not represent a real person. To contact the Forum Team email forumteam@moneysavingexpert.com0 -

Admin fees are catalogue companies wording for interest charges. These are only claimable via the CCA route to show there was no agreement enabling them to charge interest. (ie send them a request for your consumer credit agreement then negotiate a settlement of the amount you have spent less the interest you have paid - IF there is no agreement)
The fees you can simply claim back are those for late payment as they are deemed penalties. JD Williams group companies will repay these, in the main, before having to take them to court.
So check which kind you are trying to reclaim firstly.LegalBeagles0
