    you can download a n1 form from the courts website.........then use this site to fill it in......it's what i used.

    Hi mani,

    I believe they are given until 4pm on the Monday, however you can try on the Saturday to see if it works. What a pain in the neck :D


    Q. I am entering judgment by default but a message comes up stating you cannot enter judgment by default at this time, why does it say this?
    A. This is because the defendant's time for filing a response has not yet passed. If their deadline fell on a weekend or bank holiday they are given the next working day to respond. It may also be because the defendant has filed an acknowledgement of service, which gives them an extra 14 days to respond.

    Ok so 'Judgement Day' has passed without Nationwide defending; I've clicked the judgement button and requested judgement by default; can anyone shed any light on what happens now? How long does it take for the court to isssue a default notice to the bank? and then how long until they pay up? Also do the bank write to you to acknowledge their defeat or will the money just randomly turn up in the account one day?

    have you heard anything yet ? I believe my claims heading the same way as yours seeing as my application for judgement has been refused today and i dont know why

    Hi Andy

    I clicked judgement by default today, and it just goes through your details again and there's a bit where you can put when you want the money paying by or if you want it in installments. I put I want it in full by next Monday!!! Maybe a bit soon but it's my money!!! If they don'y pay by then I will ask for all the interest back. I only put what we asked for in the original claim, no extra interest since the claim went in,. Good Luck to everyone. Will let you know how long it takes to get my money back!!!!

    Hi all

    I entered Judgemnt yesterday . I have just checked today and now says rejected I suppose that means that Barclays have entered a defence!

    I spoke to lady this morning at MCOL, who said that I could apply for judgement but she also said that they hadn't cleared all the post yet, so in between you clicking judgement and this morning, they could have found in the post, a defence from your bank. I'm waiting to see if they do the same with mine.

    I issued with MCOL against HSBC on the 21/3/07 and it was aknowledged on the 23/3/07. Since then nothing, although i have had an offer which i have accepted as part settlement and informed them i will be claiming the rest.

    Can some one tell me do i wait 28 days from the issue date or the aknowledge date??

    Also, in my offer letter from the bank, they informed me that i was 2 months over the 6 years, resulting in £5 worth of charges. I have wrote back accepting this fact and debducting the £5 off the rest of my claim. Does this now ruin my chances with MCOl as the dates were wrong, and the amount worng by £5??

    Filled in the Court forms and it's coming up as Northampton County Court, which is nowhere near where I live. Can anyone throw any light on this? Is it likely to be moved?

  • I filled in my MCOL claim last night, it was really quite straight forward following the advice on here apart from 1 thing.

    Post 6 on this thread showing what to insert in the particulars of the claim. It worked fine apart from when I hit that I want to claim interest it gave me another paragraph that I MUST insert. Obviously this took me over my wording limit and it took me some time to read further through the thread to discover that this additional paragraph is NOT required as the original one covers it.

    May I request that a note be made in post 6 (or somewhere near the beginning) that the additional paragraph does not need to be added. This will simplify the process even further.
