I havnt as of yet, all I can think of is the court you are using is getting tired of bank claims and is maybe forcing the bank to defend. Im not even sure if thats possible but the court time being used up for this is phenominal and the courts must be looking for a way round it. Making them defend a case may well be the way.0 -
Erm...look again...its an 0845 number ...local rate...Cheaper stillStick to YOUR timescale. Dont take ANY bull. DONT be intimidated. The law is on OUR side.

I suspect your bank have been sneaky and asked for more time to submit a defence. They are reluctant to have judgment made against them.
I could be wrong, but this is likely.

Yes I am sorry it was an 0845 number but they are not cheaper for some people . Have a look at Heinz's post here.

I have recently been going through the motions of claiming whats mine back from the dreaded BARCLAYS. Martins advice was to time the processes to the second if you could. However Barclays filed an acknowledgement of service at the last second which gave them a further 14days. The 14 days was up yesterday and no defence was entered, so at 1 min past midnight today I filed for judgement by default.
Great I thought until ...... I phoned MCOL this morning to check everything had been done right. It had but was told that my default would not go on the system until Tues next week due to them closing at 4pm today. Barclays can still file a defence up to the point of MCOL registering it on their system (Tues). In effect that gives Barclays a further 5days to file. I thought that by processing it before 9am this morning it would show on the system today.
Seems to me that the MCOL system is there to give the defendant more time to delay. Its my £120 they are working with why don't they recognise the strict time limit given to Barclays. ie Barclays should have filed by 4pm yesterday.:mad:
So beware the online system does give the defendants a few more days than is stated on the papers.

Hi mani,
I submitted my claim via MCOL on the 21/03/07 and my 14 days was deemed up on the 9/04/07.
Your own claim will show as "issued" and the bank has untill the 14/04/07 to either acknowledge/defend the claim. So you know, you have to allow 5 days extra days for the claim to be deemed served hence the additional 5 days to make it up to the 14th April. So really it's 19 days initially...
Unfortunate for me my bank acknowledged my claim on the 03/04/07 (which changed from "issued" to "acknowledged" in the status online) which was followed up with a letter from MCOL a few days later to advise me of this.
It will state clearly if/when the status changes.
