The bank have 28 from date of service to file a defence...if they dont, you can ask for a judgment by default on MCOL. If they file the defence you will then be issued your allocation questionaire where you will be able to ask to have it moved to your local court. Follow the template on how to fill it in on this site..Stick to YOUR timescale. Dont take ANY bull. DONT be intimidated. The law is on OUR side.

No, thats how i know their still only getting the 14 days to respond. Apparently, according to the online help within online claim site, it means i win by default and need to then ask for judement by default. Hello, I'm in the middle of filling out the MCOL form and hoping for a little help.
In the 'Particulars of Claim' I've run across a couple of problems. My initial claim was for £2,090.50 plus interest, but Abbey have paid me a 'Goodwill Gesture' of £405.00, so the total I am claiming is now £1,685.50. So I have amended the suggested text to read;
Claimant claims: return of the amounts debited of £2090.50,less £405.00 refunded by Abbey on 06/03/07 - £1685.50 to still be returned;
Is this ok? I was going to put just claiming £1,685.50 but then the spreadsheets that I have previously sent in to Abbey wouldn't tally.
Now I'm confused as to what I should put for interest owed and the daily rate. I can't claim interest to date on the original amount that I was claiming (£2,090.50) as they have paid me back £405.00, so shall I just claim interest on this amount up to the date they paid me the £405.00 (which was 6th March 2007) and just forget about claiming interest on the rest up to the date I submit my MCOL form? According to the spreadsheet calculator this would be interest of £602.46.
And if I do this, should I now make the daily rate of interest 37p (£1,685.50 x 0.00022p)?
Therefore it would read;
Interest per S.69 County Courts Act 1984 of 8%- £602.46 continuing at 8% until judgement or settlement at a daily rate of £0.37.
And when I send in the latest copies of spreadsheets, shall I send the originals that I first sent in to Abbey with a note attached to acknowledge the 'Goodwill Gesture' of £405.00 or should I start from scratch and only send in a spreadsheet claiming the amount that I am now owed since they refunded some of my charges?
One last thing, should I end up in court and the Judge asks me how I came by the formula to calculate the daily rate of interest, ie., outstanding amount x 0.00022, what on earth do I say?
Many thanks in advance for any help given and apologies for all the questions - I did read through all 39 pages first (phew!!) to see if I could find my answer but couldn't!

I am reclaiming £2000 bank charges from Lloyds. I have now taken them to court as I did not received a satisfactory response. They have till 17th April to put their defence in. Just wondered if anyone has got to this stage and if you have any helpful information. Thanks.

I have followed the reclaiming steps on this site and have got as far as moneyclaim online. The bank acknowledged and said it would be defending the claim. After the 28 day from service deadline they didn't defend so I asked for judgment by default.This was refused and I received a letter saying there was a bar on judgment/enforcment in place and I should contact CCBC. Thanks to help on this site I learned CCBC was the County Court Bulk Centre. I am unable to call them until Tuesday so I don't know what will happen next. Has anyone had this response and contacted CCBC? Also has anyone had other unexpected responses to their claims? Let me know as the last thing we want when reclaiming is suprises!!

Hi, I couldn't find a relevant thread for this but apologies if there is one.
I filed my case with Moneyclaim last week but have since received an offer from Natwest for the full amount, which I have accepted.
The only problem is I cant see how to cancel the Moneyclaim. :embarasse

I think if you look at your claim menu on MCOL under judgment there is an option to file judgment by admission...failing that call them on 0845 6015935 tomorrow quote your claim number and tell them they have settled.
