you don't do anything....except wait, they have 14 days from when it is deemed served (which will be today if done after 10am yesturday plus five days) to acknowledge the claim....if they acknowledge then they will have 28 days from the date it was deemed served

Nel-Is that reply in response to the post that I bumped or to this post:

I filed with MCOL on Friday, do I now post them my spreadsheet with charges and interest along with my MCOL ref Number and ask them to put it with my claim?

    Cheers...............

lol sorry hun i must have gone cross eyed and not seen that you used the quote...but the answer is still the same...you don't need to do anything yet....wait to see if its acknowledged and if its acknowledge wait and see if they enter a defense....if they enter a defense you will be sent an allocation questionaire and you send the list of charges with that i think, still, you still don't need to do anything as yet
  • How do MCOL get to see the amount(s) you're claiming for - do you submit the spreadsheet to them? Or does the bank?

you input your amounts in the claim particulars to start with and then IF they acknowledge AND enter a defense you receive and allocation questionaire to fill in and send back....the spreadsheet needs attaching when returning it to the court
  • Thanks :)

Crikey. I'm off to hit submit....

Cheers for the info. : )
  • Good morning everyone, (and happy birthday Martin :T )
This morning I requested a judgement on MCOL against Barclays...the 28 days was up for them to enter a defense and they didnt, even though they said they were going to in the acknowledgment.
Now that I've applied for the judgement....What happens next????? do I just have to sit here and wait.... please help......Have I won or not and if I have when will I get the money back?

    :money: Martin My inspiration:money:

don't want to put a dampener on things BUT...i have read posts that have reported that the banks have entered their defense late and have still been allowed to submit it....some up to 3/4 days late.

i'm still in the 28 days so i don't know what happens next...sorry

    good luck though

If the banks defence is received even a few days after the first deadline. The courts normally let the case go on rather than grant any judgement. This is quite normal, and has happened many times.

You now have to wait to receive your allocation questionnaire from the court.

Barclays have got a big habit of taking the cases as far as they can, but not going into a hearing. There is not one case they have defended fully yet.

    knew i'd seen it somewhere
  • Thanks Nel, I kinda thought that once the 28 days were up, that was it  and Barclays would get the judgment against them and would have to pay up....seems thay might still have time to defend afterall...this is all so confusing, but i think i'm nearly there......

If anyone has got to this stage and can tell me what to do now I would appreciate it, thanx
