Cheers, they have stated they they will defend the claim, forgot to mention that.
Do I just hold tight until I they request further info?harder, better, faster, stronger0 -
Yes, you should receive an allocation questionnaire from the court.“A budget is telling your money where to go instead of wondering where it went.” - Dave Ramsey0

HI
I have submitted my claim on MCOL against Barclaycard
But I have a few questions
I have claimed for £432 of charges but in the meantime I have received a letter from Barclaycard saying they have deposited a goodwill gesture of £180on my credit card, I am not sure what I am meant to do now, I obviously still want the full amount should I/ can I change my claim amount to £252 or should I leave the full amount on there?
Thanks
I look forward to a reply
PS - Also I just want to verify
It asks on the form - Does or will your claim include any issue under the human rights act 1998
I have ticked no please can someone confirm if this is correct ( sorry if this sounds silly)0 -
hmm....
my claim was acknowledged by bank (a&l) on 01/02/07.
ive just tried requesting a judgement by default but im still getting the message that i cant do that at this time. by my calculations, 28 days were up at midnight last night?
anyone think different?0 -
When did you actually file your claim on MCOL? You have to add 5 days on to that then 28 days on again.“A budget is telling your money where to go instead of wondering where it went.” - Dave Ramsey0

Hi,
This is my first post. I have just received a letter with an 'Allocation Questionnaire' , which is fine, I am quite prepared to make a stand and take LLoyds TSB to court as a matter of principle. However there defence is 'the statement of claim is insufficiently particularised and is embarassing. The defendent reserves the right to plead further to the Statement of Claim once they are sufficiently particularised'. it goes on to say thatthey cannot identify the account in question or how the sum i am claiming was reached (£530).
I included the amounts with dates in letters I wrote to the bank. But, when I filed my claim online I just stated that the amount was the total taken from my 2accounts in the last 6 years in unfair penalty charges. Should I have included dates and account numbers on the claim form. What should I do now?
Any help will be appreciated, I'm starting to panic a bit!!!
Thanks,

Did you include the schedule of charges with each letter listing the Date, Charge Name, Charge Amount and Total?0 -
Hi
The HSBC has sent Acknowledgement of Service eeek. Was hoping they would just settle.
I notice on the form they intend to defend all of the claim and have a solicitors address as their reference.
Is there a chance we will not get the £6000 we are owed?
Any thoughts? x0 -
I got a similar letter of Defence from my Banks(Lloyds TSB) Solitors today more or less stating the same that my Claim was insufficiently particularised & embarrassing!
I didn't submit Bank Statements although I have 4 years worth & I estimated the other 2 years worth but only a small amount.
Have I made a mistake doing this, should I now send them the statements highlighting the Charges or do I just send them an attachment showing charges/dates/reasons for charges?
they also kept referring to me as 'She' when my name (Mark) does indicate I am male!
any advice would be gratefully received thank you0
