    d'oh.

    just checked MCOL again, and now the 'acknowledged' has turned to 'defence' !!!

    oh well, a few more weeks then.....

    So in a Nutshell dont bow down to Banks Solicitors request?

    If it should go to Court then the Court will request further evidence to my claim?

    I decided to claim my £490 from Lloyds following the steps on this site (as I had already got an easy £980 from First Direct/HSBC)

    Sent the first letter - got the reply back "we believe we are justified in taking these charges etc"

    Sent the second letter and waited 3 weeks, no response.

    So, went to moneyclaim.com and registered a claim.

    The same day I returned home to find a later laying out that Lloyds had caved and decided to pay me the original £490 "as good will gesture etc" and would automatically be transferring me the money which has since appeared in my account. Note they did not ask me to sign anything, agree to this etc.

    I wrote back to them chastising them for the tardiness of their response which had led to me to incur an extra £80 court cost and that I was now claiming statutory interest as well as per the relevant act of parliament and that had they replied when I asked this would not have been necessary. "Pay me the £119 odd difference" I stated (though not quite like that) and we'll call it quits.

    They have ignored the letter and entered a defense, which I received yesterday.

    Anyone else reached the stage of the bank entering a defense? I plan to fill out the questionnaire for the court and see where we go. Also where do I stand on the £490 already paid, i didn't accept it as such and it was paid as a gesture of goodwill - will this show slight liability/(guilty feeling) on their part in court, or is it a nice "gift" :beer:

    Any thoughts from anyone at a similar stage, I am fully aware this is probably bluster to get me to be all scared of the bank, but I am more than willing to take this to court - that would be great fun (especially as I already have my £490 goodwill)

    ive just got home at dinner and there is a chq for £1198 waiting for me from A&L. problem is, claim was for £1679. in the letter they write that the charges from 01/01/2001 amount to £794 + interest. is this just their way of trying to do me out of £500 (ish), or could i really have miscalculated my charges by that much?

    so whats the next step now if i wanna hold out for £1679? can i bank this chq or do i have to return it and tell em to stick it where the sun dont shine? do i have to tell MCOL that i have recieved a partial settlement, or will that be sorted when i recieve my AQ.

    thanks for any advice....

    btw, i have claimed for a 'monthly od charge' (£5) that kept appearing on my statement since my account changed to a 'premier direct' one. are these refundable does anyone know?

    the £5 monthly o/d charges are not reclaimable i'm affraid

    maybe those charges at the beginining of list (jan 01) were in relation to your december 2000 charges....wouldn't these be before the six year limit?

    i THINK your only allowed to claim the charges six years previous from the date they recieved your initial request for refund or maybe its from when you requested the statements....you might find that they have taken off the charges before the 6 yr period plus the £5 monthly o/d. I think you need to do a quick calculation before regecting the offer
  • I too have just received a defense claim from Lloyds. Im definitely biting the
    bullet but would love some feedback from anyone who has completed this stage
    of the battle.Any tips would be greatly received too!

    You need to inform MoneyClaim if you have received any payment towards your claim, according to the FAQ you can email, fax or phone.

    Same for cancelling the proceedings.
