No this means that Nationwide are defending your claim and you will need to wait for the Allocation Questionnaire to be sent to you to fill in.

The court will do it. I'll move this into the MoneyClaim thread where you'll find the answers to any other queries you might have about the process.

    Hi,

    Just want some clarification really:

I issued claim against on 31/01/07 (after 7pm). (the courts deem it to be served 5 days after issue). Issued say 5/02. They acknoweldged on 08/02.

Do they 28 days start 5th Feb (when they are deemed to have been served) or is it when they acknowledged 8th Feb.

If its the 5th, the time up is this Sunday, if its 8th it is up on Tuesday.

I am itching to press Judgement button.

Also is it working days or calendar days? And because the courts are not open sat/sun, could i technically do judgement tonight say 11ish, ready for Monday. As stated above if it is 5th then they would surely have to put defence in today (which as of yet they have not).

Please, please, please say i can press that judgement button!

  • Hi nickmack,

Sorry for delay in reply - been round and round in circles on here trying to find my question!!

All I included in my letters to the bank was the following:
    Re: Account number *****56.
    Dates: November 2000 – May 2006.
Charges relating to ‘Unauthorized borrowing Fee’, ‘Overdraft Usage Fee’ and ‘Overdraft excess Fee’ total amount = £365.00 (not including interest charges).
    ALSO,
    Account number ******68.
    Dates: February 2002 – August 2004.
Charges relating to ‘Overdraft excess Fee’ total amount = £165.00 (not including interest charges).

Which I had worked out from the list of charges they sent me.
Should I have included this info in my court claim, I just put the total amount on the claim form?

    thanks, maltababy.

    Hi,

Today I've sent my first leter to HSBC asking for a refund of my £1582.74 charges (including 8% interest) and I've been going through all of the threads on here to give me an idea about what happens next.

Early on in the thread someone talked about spreadhseets. This is the first I've heard of spreadsheets as I worked out my interest from old online statements. If my claim goes as far as Moneyclaim or the court do I need to create a spreadhseet (if so, what details should I include?) or would a copy of my statements be sufficient?

    Many thanks in advance.
