    Ok i am confused. I am about to take Abbey to court and am filling my money claim form out. Most of it makes sence but i am not claiming overdraft intrest so how does this change the wording. A copy of which is below, the bit i think i need to remove is in red.

    1. The Claimant has an account ??????? & ??????? with the Defendant, opened nov 2000 2. Since 31/10/05 the Defendant debited charges and interest in respect of purported breaches
    of contract. 3. Defendant is aware of all
    details as a list of charges has already
    been supplied. Another copy will be sent.
    4. Claimant contends: (a) The charges
    exceed the Defendant's losses caused by the
    breaches; (b) The Term permitting the
    Defendant to levy such charges is
    unenforceable under the Unfair Terms in
    Consumer Contracts Regulations 1999, Unfair
    Contract Terms Act 1977 and at Common Law.
    5. Claimant claims: (a) return of the
    amounts debited of £1784; (b) Interest per
    S.69 County Courts Act 1984 of 8% - £120.73
    continuing at 8% until judgment or
    settlement at a daily rate of £0.xx; 6.
    Alternatively, if the charges are a fee for
    a service, then they must be reasonable
    under S.15 of the Supply of Goods and
    Services Act 1982. 7. Costs allowed by the
    Court.

    Hi, just got off the phone to mcol after the abbey decided to defend my claim at the very last minute,its now going to my local court, so i've got to fork out another £100.
    what happens next and do you think it will get to the court stage or are they just stalling for time??:confused:
    trust me to be with one of the most awkward banks :mad:

  • In my opinion I dont think it will get to the court but you must be prepared for this to happen. Abbey said they would defend mine sent the forms stating their defence (usual things) and then just days before court date sent a letter asking if i would accept half I of course said "Not blooming likely" and they accepted that they would have to repay me the 3000.00 pounds. Good luck but remember every claim is different. try looking on Consumer Action website they have different sections for each bank and many people going through the same stage as you.:)

    All cases start out at Northampton, it will move to your local court if it comes to that.

    A Barclays customer went to court yesterday, although Barclays didnt show up, here is the thread

    Dont know if anyone can help but in my haste to fill out the MCOL form, in the particulars of claim, before reading this thread, I was unsure what to put so just put

    'I feel the charges that I have had to pay have been illegal as they do not represent the true cost to the bank'

    Could this cause me problems in my claim? Can I change the wording in there or is it too late (I put the claim in on Fri)? :confused:

    I filed my cliam on sunday but have noticed I have claimed back to Nov 2000 which is just over the 6 years will this affect my claim. Bit worried !!
