    hi

    abbey defence papers arrived today,they also offered me £1135 which is half of what i'm claiming#
    their defence claims that" my claim sems to be based on the fact that i should not pay any charges at all"

    two questions really:

    1) is this a standard thing they try to do to scare me into accepting offer

    2) do i have to inform them that i am not willing to accept settlement and will be continuing with the court proceedings once i have filled in my allocation form

    Can you tell me how many days l have to give the bank once they have acknowedged my claim is it 14 days or 28 days

    its actually 14 days once its acknowledged then they will offer a defence
    its 28 days from when the claim was issued

    Sorry if I'm being dim - I just want to know when to expect certan things to happen.

    So.

    I lodged by my claim which showed as 'Started', then within about 7 days it changed to 'Acknowledged'. So now, from the time it changed to 'Acknowledged' they have 14 days to get a defence in?

    I suppose what I'm asking is how long can the process potentially last?

    The claim was served 5 days from the start date online. They have 14 days from then to put in a defence. If they acknowledge, it gives them a further 14 days, so 28 days + 5 is the longest length of time.

    I've just this moment opened my post and I've had an 'acknowledgment of service' letter telling me that they're going to defend all of the claim.

    Suddenly I'm really, really worried this going to backfire and I'm going to end up with shedloads of court fees to pay :(

    Is this letter normal? What does it mean?:(

    An acknowledgement doesnt necessarily mean they are going to defend.
    Cant advise though, as my bank havent defended yet.

    I do not know when my account was opened, i only have a rough idea. What shall i put in the following paragraph on the particulars of claim?

    "The Claimant has an account 99999999 with the Defendant, opened November 1998. Since 19th October 2001 the Defendant debited charges and interest in respect of purported breaches of contract. Defendant is aware of all details, as a list of charges has already been supplied."
