I have filed a claim against HSBC with MCOL stating the very barest info just the amount and they paid up in four days with no hassle or any extra information required. As soon as they receive a summons from MCOL the bank will pay up.0 -
This may have been the case with your claim against HSBC but this is not necessarily the case with all banks.0

Yes, you only have to read the forums to see how many banks are filing defences and even letting people turn up at court and getting default judgement there to know that HSBC are a rarity in how they appear to be handling claims.0 -

However, Lloyds' defence is based on "they are not penalty charges, they are fees for a service" they even state "There is no breach of contract; the charge cannot therefore be a penalty, consequently there is no requirement that the charge be a pre-estimate of the bank's loss"
The guide for filling in Section G of the AQ is based on breaches of contract and costs incurred by the bank etc so is this still relevant in light of their defence or is there something else I can use based on their so-called services?

could anyone tell me how to claim if your bank is based in scotland? im with intelligent finance and the website suggested on here does not cover scotland, and im stuck as to what to do next0
