    theres a box that you tick (maybe you haven't got that far yet) if you want to claim interest....when you tick the yes box, a box will appear saying "if you want to claim interest then you need to including these words in your claim details (of something to that effect) and goes on to mention "Interest per Section 69 County Courts Act 1984 blah blah etc etc"

    what i was meaning is have you copied and pasted this text into your claim details box?

    if so take it out, because it is already detail in the claim details that i just posted but its just abbreviated to fit

    I'm at step 5 of 8:

    There's the box to paste in the particulars of the claim - which I'm having problems with.

    Then there's the Human Rights Act tick box

    Then there's 'Reserve the right to claim interest' tick box

    Is this last tick box the one you mean?

    If I tick it (which I currently am doing) which bit of this statement (taken from the suggested Particulars of Claim template on this site) do I then remove?

    Between the dates of xx/xx/xx and xx/xx/xx the Defendant applied numerous default charges to the Claimant’s bank account. The charges applied constitute an unfair penalty under the Unfair Terms in Consumer Contracts Regulations, which state: “A term is unfair if it requires any consumer who fails his obligation to pay a disproportionately high sum in compensation”. The amount charged does not reflect the cost of the breach. Under the law of penalties, the charges are an unlawful ‘extravagant’ penalty. Referring to the case of 1896, Wilson v Love, a charge is a penalty if it does not reflect an item’s true cost. Under the County Courts Act 1984, the claimant is entitled to interest at a rate of 8% per annum from the date they were first deprived of the money to the date of this claim. This amounts to a total sum of £xxx, continuing to accrue at the statutory daily rate of 0.021% until judgment or earlier payment. The Claimant therefore asks the court to enter judgment in their favour for the sum of £xxx plus interest, amounting to a total of £xxxx
  • i have a claim for over £4000 and have filed legal proceedings on the moneyclaim website, however they have now aknowledged the claim and have filed a defence.can anyone tell me if i actually need to go to court and what to do next please help getting a bit panicky!

  • I filed my claim against Halifax with MoneyClaim on 23rd Feb, having gone through the correct process with and not had a satisfactory response. I was happy doing this until I eventually found the time to sit and punch in the numbers and calculate the interest, I would be owed £247 on top of what I have requested, am I able to update my claim with moneyclaim asking for this, or should I file another one?

    I filed with MCOL on Friday, do I now post them my spreadsheet with charges and interest along with my MCOL ref Number and ask them to put it with my claim?

    you don't do anything....except wait, they have 14 days from when it is deemed served (which will be today if done after 10am yesturday plus five days) to acknowledge the claim....if they acknowledge then they will have 28 days from the date it was deemed served
