    Got through the parts for filing a claim for Capital one no bother,thanks to this site,then to pay for the filing of my claim they dont accept my debit card which is Visa Electron!!

    Anybody got any ideas as what to do now!

    Barclays are likely to settle before court or not turn up as well.

    However, the one thing you must do is check that their defence has no merit. If, for example, you have made an error on your claim, then their defence may be valid. You need to just make sure that their defence is pretty standard and that you have not given them a window of opportunity.

    Hopefully someone else will be along shortly to help you with what to put in the information box.

    i've only just found your response to my post above. we are now at the point where abbey have filed their defence and made a further offer to settle, only about half the amount i'm claiming. do i still need this form N244 you mention or can i put the previously omitted details in the next from i8 get from the court - cant remember the name of it?:confused:

    I'm just completing my form on moneyclaim, having spoken to someone at bank's customer relations dept who confirmed that this is 'still being looked into' (original request to reclaim fees was 24th Jan with 7 day letter sent over a week ago - so they're definitely either horribly backlogged or just delaying as much as possible) - now although there are so many success stories here, this step is still a little scary - can someone help with a couple of questions re the moneyclaim form please?

    1) the suggested wording on this site goes quite a bit over the '1080 characters on 24 lines' allowed in the 'particulars of claim' section of the moneyclaim form. However, all the wording suggested on this site looks as though it is necessary - how have people 'trimmed' this to get it down to size?!

    2) the amount of interest has obviously increased since my original claim. I put the new amount in, right...? even though now the two won't match up?

    3) 'Does or will your claim include any issues under the Human Rights Act 1998?' - I haven't the foggiest :-) anyone help here?

    It does fit, you may need to delete some spaces between sentences and/or remove whitespace below and above the text.

    Remember you are not entitled to claim interest until the claim stage. If the difference is minimal, I would just stick to the original amount.

  • It doesn't fit for me either - even if I remove all carriage returns, extra spaces and whitespace - and even full stops!

    I'm not sure what I'm doing wrong but every time I press Submit it comes up with:

    WARNING: Claim Particulars: This information is required and must be no more than 24 lines or 1080 characters. The following characters cannot be used < > & "

    There aren't any of those characters in there as I've removed the " entries?

    It's usually the number of lines that causes a problem, I'd count just to check.
  • Ok, it insists on 24 lines, and 1080 characters.

    The suggested text on this site, even with ALL carriage returns, extra spaces, whitespace, and point numbers removed is still 25 lines long!

    I've no idea what I can trim out of it, and what I can't without jeopordising my claim!

    Any thought please! I want to get this in ASAP!

    try this one, its a little more abbreviated and as posted by Rex in early threads

    The Claimant has an account xxxxxxxxx with the Defendant. Since xx/xx/xxxx the Defendant debited charges and interest in respect of purported breaches of contract. Defendant is aware of all details as a list of charges has already been supplied. Claimant contends: The charges exceed the Defendant's losses caused by the breaches; The Term permitting the Defendant to levy such charges is unenforceable under the Unfair Terms in Consumer Contracts Regulations 1999, Unfair Contract Terms Act 1977 and at Common Law. Claimant claims: return of the amounts debited of £xxx.xx; Interest per S.69 County Courts Act 1984 of 8% - £xx.xx continuing at 8% until judgment or settlement at a daily rate of £x.xx; Alternatively, if the charges are a fee for a service, then they must be reasonable under S.15 of the Supply of Goods and Services Act 1982. Costs allowed by the Court.

    if so take it out cos its already in the details but abbreviated
