Hi,
I only just found this thread so didnt use the template letter for the money claim online. What I put in my claim was basically a copy of the last letter I sent to the bank is this ok?
It provided how much I was owed etc.0 -
Hi to you all, I am very pleased to be a member of this cool site!
I submitted my claim through Moneyclaim on 16th February and has been accepted. My claim is for £4,437.43 (including interest) from LloydsTSB and I have rejected their partial 'gesture of good will' of £690.
Double checking my claim I have realised I have made 2 mistakes 1) I have made the claim including Overdraft Interest which amounts to something like £300 which I didn't realise I couldn't claim for and 2) I have put £6.5% in the daily interest rate instead of £.65 or .65%.
Could someone let me know whether these 2 things are going to severley ruin my case and whether I should start again?0 -
Can some one give me some advise please.Well i have sent off the claim forms to my courts i done it this way as im exempt from paying the fees.What will happen now ? How long does the nationwide have to pay up and what happens if they dont pay up in that time ? Do i have to do anything else,or just sit and wait and will nationwide pay up ? I really hope someone can help me on this, i am desperatly trying to complete my moneyclaim form online and am getting a bit confused!
Having sent all the initial letters and then LBA to Barclays, they offered part settlement which i accepted on the condition that I would continue to claim for the outstanding balance, they then replied saying that was their final offer and it was that or nothing.
So now I am now proceeding with court action via moneyclaim.
I just want to be absolutley clear on something though, with regards to the following which I am using in the 'particulars of the claim' section;
1. The Claimant has an account 1234567 with the Defendant, opened May 2000 2. Since 01/02/03 the Defendant debited charges and interest in respect of purported breaches of contract. 3. Defendant is aware of all details as a list of charges has already been supplied. Another copy will be sent. 4. Claimant contends: (a) The charges exceed the Defendant's losses caused by the breaches; (b) The Term permitting the Defendant to levy such charges is unenforceable under the Unfair Terms in Consumer Contracts Regulations 1999, Unfair Contract Terms Act 1977 and at Common Law.
Im fine with all the above
5. Claimant claims: (a) return of the amounts debited of £XXXX; I am just putting the total amount owed including interest which I have asked for throughout, as per the Martin Lewis website, is this correct?
(b) Interest per S.69 County Courts Act 1984 of 8% - £xxx [enter interest total at date of claim] is this what i have already worked out on the martin lewis website or do i need to do something else using the spreadsheets that are mentioned on the CAG website?continuing at 8% until judgment or settlement at a daily rate of £0.xx; I think i have worked this out correclty, the figure i used to calculate was the TOTAL amount i am claiming for including interest
6. Alternatively, if the charges are a fee for a service, then they must be reasonable under S.15 of the Supply of Goods and Services Act 1982. 7. Costs allowed by the Court.[/I]
Once I send this off on the moneyclaim website, do i get a prompt for me to send my bundles?
Also, should i send a seperate letter to Barclays and Moneyclaim with the paperwork which details all my charges and interest charged? Barclays do already have a copy which i sent in my original letter. Presumably if i do this I will need to send a covering letter but what should I say?
Sorry for all the questions, hopefully thats it now!

Does that mean that the 14 days the bank has to respond to the claim starts from the 12th February? I've also read that there's a 5-day lag before the 14 days starts (to allow the letter to get there).
I also know that if the Bank acknowledges it within 14 days (or is it 19, including that other 5?!) then they get a full 28 days from the date the claim was served (is that the same as issued?)
Can anyone put me straight on all this!?

Dear All,
Just registered but have been watching the site for w while. You are all just grand.
Tomorrow is a big day as I am taking A+L to court, but am a bit confused by the online moneyclaim template:
"Interest per S.69 County Courts Act 1984 of
8% - £xxx [enter interest total at date of
claim] continuing at 8% until judgment or
settlement at a daily rate of £0.xx;"
So, I used Martin's calculator and my interest to date is £225.65, which I guess I put in the first blank. But what about in the 2nd one? What is the daily rate?

Hi There,
I am just doing the MCOL for my parents after successfully getting my money back this week.
Thing is they have a joint account and i dont want to get it wrong, do i have to include both of them as the claimants as i can only see room for one person?
Any help would be apreciated!

Hi Nat West have not filed an admission or defence to my claim using MCOL
and now need to ask for Judgement by default
the amount claimed is £1641.02 including initial interest of £198.00
can any one give me a formula for working out the additional interest on this amount from the date of claim so I can add this when asking for the Judgement by default. Or how much per day this equates to.
