    The Claimant has an account XXXXXXXX with the Defendant, opened (DATE XX/XX/XXXX). Since (DATE XX/XX/XXXX) the Defendant debited charges and interest in respect of purported breaches of contract.


    i haven't got a clue when my account was opened for the first date

    the 2nd date ...do i put in the date of the first charge?

    Change it to...................

    ok i've done this bit:-

    The Claimant has an account XXXXXXXX (put your account number) with the Defendant, opened (DATE XX/XX/XXXX). Since (DATE XX/XX/XXXX) the Defendant debited charges and interest in respect of purported breaches of contract.Defendant is aware of all details as a list of charges has already been supplied. Claimant contends: The charges exceed the Defendant's losses caused by the breaches; The Term permitting the Defendant to levy such charges is unenforceable under the Unfair Terms in Consumer Contracts Regulations 1999, Unfair Contract Terms Act 1977 and at Common Law. Claimant claims: return of the amounts debited of £XXXX; Interest per S.69 County Courts Act 1984 of 8% - £xxx [enter interest total at date of claim] continuing at 8% until judgment or settlement at a daily rate of £0.xx; Alternatively, if the charges are a fee for a service, then they must be reasonable under S.15 of the Supply of Goods and Services Act 1982. Costs allowed by the Court.

    and i've made the changes to suit my claim

    now then am i thick???!!!! no don't answer that one ( i know the answer already)

    when you click to say yes to the interest the box comes up up saying

    Since you have indicated that you wish to claim interest on the money the defendant owes you, you must include the following text in the particulars of your claim:

    The claimant claims interest under section 69 of the County Courts Act 1984 at the rate of 8% a year from {date when the money became owed to you} to {the date you are issuing the claim} of £ {put the amount} and also interest at the same rate up to the date of judgment or earlier payment at a daily rate of {enter the daily rate of interest}.

    am i right in thinking that this is already stated in the first part that i have already put just abbreviated slightly to fit?

    hi all

    i thought i had read a question on here asking if MCOL accepted visa electron and i thought the reply was yes

    well i have just tried using mine but it hasn't worked (yes there are sufficient funds in there)

    has anyone else had the same difficulty?

    I have won my charges back and have had them paid directly into my account. What do I do with my moneyclaim online? Is there somewhere I withdraw the claim and state they have paid?
  • Contact Moneyclaim and tell them you want to stop the claim because the bank has made an offer you have accepted. They will advise you how to do this. <!-- sig -->

    Please select the Claim menu button to go to the claim menu to try again or contact the Customer Help Desk.
