Thanks for reply but I don't agree with you, it specifically says-
"If the Defendant files an Acknowledgement of Service within 14 days of receiving the claim form, they will be entitled to 28 days from the date they were served with the claim form to file a defence or admission of your claim"

28 days from the date they were served with the claim form, which the court says was the 20th Jan (went off on 15th Jan), so in effect they are just getting a further 14 day extension, rather than another 28 days on top. So the 17th Feb should've been cutoff date.

Aha, problem solved, just logged back in and it now says they've entered defence, must've lagged a couple of days updating the online claim.
Now to wait for allocation questionnaire etc...

The 7 days is the letter i sent to the nationwide threatening them with the courts not the claim letter. You do have to give them 7 days dont you, then you take things further ?

  • There are three letters, the last one, letter before action, you give them 7 days to reply or you will be taking court action.

above poster has now edited both posts from 14 days to 7 days.
  • I filled in the Money Claim online form on 11th February. It says that the claim was 'issued' on 12th Feb. It doesn't use the word 'served' but i have had a letter back from the court called a "notice of issue" (also dated 12th Feb).

Does that mean that the 14 days the bank has to respond to the claim starts from the 12th February? I've also read that there's a 5-day lag before the 14 days starts (to allow the letter to get there).

I also know that if the Bank acknowledges it within 14 days (or is it 19, including that other 5?!) then they get a full 28 days from the date the claim was served (is that the same as issued?)

Can anyone put me straight on all this!?
  • I'm filling in the moneyclaim online form now - and want to add 8% interest.

How do I calculate the interest - is it per charge calculated from the date of charge.

OR is it 8% flat of the whole amount - eg my total is 932.00, so is interest 74.56 ????
  • You calculate all the charges seperately and then add it up at the end , its calculated in date order
