    you calculate your daily interest like this

    total charges (not interest) X 0.00022 to give a daily amount

    check post number 201 on this thread where rex answered my same question

    but i think in your case it will be 1443.02 x 0.00022 = 0.317 rounded up to 32p per day

    My claim was issued by MCOL today, and the defendant (A+L) has 14 days to respond

    Could someone tell me if 14 days is 14 working days or 2 weeks?

  • Capital One have acknowledged my claim.

    "The Defendant is allowed a total of 28 days from the date from when they are served with the claim to reply."

    What is the date they are served? The date the MCOL was started? Or the date they acknowledged? Sorry if this is a stupid question, but the difference is 2 days and I want to request judgment by default ASAP assuming they don't defend.

  • The Claimant has an account ********* with the Defendant, opened 2004. Since 15/09/2004 the Defendant debited charges and interest in respect of purported breaches of contrac . Defendant is aware of all details as a list of charges has already been supplied. Claimant contends: The charges exceed the Defendant's losses caused by the breaches; The Term permitting the Defendant to levy such charges is unenforceable under the Unfair Terms in Consumer Contracts Regulations 1999, Unfair Contract Terms Act 1977 and at Common Law. Claimant claims: return of the amounts debited of £589.50; Interest per S.69 County Courts Act 1984 of 8% - £64.79 continuing at 8% until judgment or settlement at a daily rate of £0.14; Alternatively, if the charges are a fee for a service, then they must be reasonable under S.15 of the Supply of Goods and Services Act 1982. Costs allowed by the Court.

    I work mine out at 0.14, is that right? or should I use 0.22? Very confused please help, now filing on money claim

  • Hi to you all, I am very pleased to be a member of this cool site!

    I submitted my claim through Moneyclaim on 16th February and has been accepted. My claim is for £4,437.43 (including interest) from LloydsTSB and I have rejected their partial 'gesture of good will' of £690.
    Double checking my claim I have realised I have made 2 mistakes 1) I have made the claim including Overdraft Interest which amounts to something like £300 which I didn't realise I couldn't claim for and 2) I have put £6.5% in the daily interest rate instead of £.65 or .65%.

    Could someone let me know whether these 2 things are going to severley ruin my case and whether I should start again?

    I received an acknowledgment of service from Barclays after beginning court proceedings through Money Claim on 25/01/07. It say's the defendant now has 28 days from the date of service of the claim form to find the defence. It's been 28 days, yet when I try to ask for judgement by default it say's it's too early.
    Can anyone help me with this?
    Also, what is and why haven't I got one, the questionnaire that is talked about on this forum regarding this issue?

    My bank has refused to refund my charges, and i am now up to stage 4. :mad:
    I am trying to start my small claim but the online system keeps saying the postal code i'm putting in for Alliance and Leicester is incorrect. Admittedly it doesn't have a conventional looking post code, but i know its right. Anyone got any suggestions?? :o
