I'm using the MCOL. I am guessing that it is the Branch that I claim against rather than Head Office address?0

I initially claimed for £200. Bank refunded £90
Do i include this in particulers or just claim for the £110 and not mention this0 -
Hey, i really hope someone can help me.
I started court action against the royal bank of scotland yesterday via the moneycliam website, i have logged on today and under the section that says Judgment it say "STARTED", when i click the started word it takes me to the Judgment - select type of judgment section, then it gives me two options ether
1), The defendant has not filed an admission or defence to my claim
(Judgment by Default) You will need to decide, how and when you want the defendant to pay. You can ask for the Judgment to be paid by instalment or in one payment. OR
2) The defendant admits that all the money is owed
(Judgment by Admission) If the defendant has given a new address on the form of admission to which correspondence should be sent, update the defendant's details within the following Judgment request.
WHAT DO I DO, this is the first time i have had to get to this part of claiming my bank charges, i really dont want to me it up
PLEASE HELP ME0 -
Hi
I am sure I am not the first to have major aggro with Woolwich and Barclays!
I have been communicating so far with Barclays head office, as they have been writing to me.
I have been offered a second offer of £2000, but my full charges minus interest come so £4812. I would settle for £4000 but no less.
Anyway I have threatened court but nothing. Before starting moneyclaim (doing so today)on wed, I faxed charges and every single letter to barlcays and gave them 1 last chance to pay me by Friday, but nothing.
So now I am filling in the money claim and the template letter.
But I am very very confused.
1. Who am I taking to court Woolwich or Barclays?
2. How do I work out the interest? Can I just add on 8 percent interest for the totaly amount?
3. I would prefer the amount to come to no more than £5000, as does it not make it difficult to take to a small claims court over that amount? Can i not ask for this amount only?
Sorry for all the questions!
many thanks

Woolwich

Use the Interest Calculator in Martin's article and input each charge individually, this will give you the correct amount of interest to claim.
3. I would prefer the amount to come to no more than £5000, as does it not make it difficult to take to a small claims court over that amount? Can i not ask for this amount only?

The £5,000 limit does not include interest so your claim will be fine.0 -

magicsal wrote:Hi,
I received an acknowledgment of service from Barclays after beginning court proceedings through Money Claim on 25/01/07. It say's the defendant now has 28 days from the date of service of the claim form to find the defence. It's been 28 days, yet when I try to ask for judgement by default it say's it's too early.
Can anyone help me with this?
Also, what is and why haven't I got one, the questionnaire that is talked about on this forum regarding this issue?
Many thanks.
The MoneyClaim system won't allow you to do anything until the correct date. The AQ is only sent out if the bank enters a defence.0 -
Do i really need to put in each charge individually, wow, thats gonna take ages, ive got pages and pages..
is ther enot a quicker way!?0 -
Ahh lol
Ive found the calculator, its really easy to use isnt it!
Cant believe how much interest is accrued since 2001!!!!0 -
