I am working my way through the MCOL form for a claim against RBoS/MINT for 3 late payment charges.
I have a couple of questions about the particulars template on this thread.
Firstly, I cannot remember exactly when I opened my account. It was well over 6 years ago, and was as an Access card with Williams & Glyns Bank. They were then taken over by The Royal Bank of Scotland, then my card became an RBS Advanta card and finally a MINT card.
Secondly, for "(date when the money became owed to you)" can I put the three dates of the three late payment charges?The acquisition of wealth is no longer the driving force in my life.0 -

Sorry if this has been posted elsewhere but i cant find it, with a week to go till the end of the 28 days Mint have paid up :beer:
Need to cancel or withdraw my claim now so wondered the best way to do that ?

Well Im at the online moneyclaim courts step and now I'm waiting but I was wondering it says on the net that 'it takes 5 days to be serviced' and 14 days till it has ended does this include weekend days? :beer:0 -

The Claimant has an account xxxx xxxx xxxx xxxx with the Defendant. On 12 April 2005, 13 October 2006 and 9 April 2007 the Defendant debited charges in respect of purported breaches of contract. Defendant is aware of all details as a list of charges has already been supplied.
Claimant contends: the charges exceed the Defendant's losses caused by the breaches; alternatively, if the charges are a fee for a service, they are not reasonable per S.15 of the Supply of Goods and Services Act 1982; the Term permitting the Defendant to levy such charges is unenforceable under the Unfair Terms in Consumer Contracts Regulations 1999, Unfair Contract Terms Act 1977 and at Common Law.
Claimant claims: return of the amounts debited of £44.00; costs allowed by the Court: interest per S.69 of the County Courts Act 1984 at 8% a year from 12 April 2005, 13 October 2006 and 9 April 2007 to ?? May 2007 of £?.??, continuing at 8% a year until judgment or earlier settlement at a daily rate of £0.01.The acquisition of wealth is no longer the driving force in my life.0 -

vinny, don't cancel your claim with the court until you actually have the money via cheque or in your account!0
