i never mentioned interest until i filled my mcol
should i have sent a form explaining how it was made up. ?
i just wrote the amount it came to.

Have you produced a spreadsheet with the reason for charge, amount and 8% interest on top? I did this just after starting my claim on MCOL ... rang them up and emailed them a copy and sent one to the bank.icon7.gif
    Wins since 2009 = £17,600

No, you've not messed up. You could just send Martin's interest schedule to the court and bank, but this does not state the reason for the charge and you may need a "complete" schedule giving all the info. together at a later stage. I've just had to send my schedule to the bank's solicitors and, if they have all the info. together, they're less likely to keep asking you for more details.

Just produce a schedule stating the Date/Reason for Charge/
Charge Amount/8% Interest/Total ... ring the court and ask if they want it emailing and make sure you send a copy to the bank, so they're aware of the details and can't use it in their defence that you haven't sent it to them (though they'll probably state they haven't received it anyway as a delay tactic!).

    Hope this helps.

    Help!

I have a current MCOL case against Lloyds TSB. It was issued on 19 April and no acknowledgement yet. However, today I received their standard letter offering £750. This is more than my total MCOL claim so obviously I want to accept that. How do I cancel the MCOL?

I haven't actually got the £750 from Lloyds yet - just the letter saying they will pay me that.

I don't want the MCOL to proceed and for them to then decide to drag that out for a lesser amount...

If you go to reclaim article, about half way there is an iterest calculator. All you do is put in the initial value of the charge and the date it was taken from ur account, and it works out the interest for you. When you have done all the cahrges, print out two copies (one for them and one for you to keep). That should be all you need.

I had a feeling this was what was going to happen - got notice today that Natwest intend to defend all of my claim

I'm feeling pretty sick about it this morning, despite all the brave words I've spoken to others. Could do with some moral support please !!!!

I've sent the relevant letters and filed with Moneyclaim a week ago.

I've just noticed that I've missed off the interest, by entering the charges amount and not the amount including interest.

Is it possible to cancel the original claim and try again, I can't see a way of doing this online and would I lose my £120?

The interest alone comes to £500, so it would be worth it, even if I lost the £120.

    Cheers.

If you ring the court, they'll take you through how to make an amendment ... it involves filling out a couple of forms I gather and costs £35. They're very helpful ... I should know, I've rung them loads or times:rolleyes:
