I have just logged on to my MCOL claim, and there is an option to start a judgement.... do I need to do this yet? Or do I wait til the 14 days are up?'We are all in the gutter, but some of us are looking at the stars' - Oscar Wilde0

You need to wait til the 14 days are up, from when the Claim was served on the bank - don't think it would let you apply for judgement until then. The Notice of Issue sent to you by the Court should give the date by which the bank have to respond.

My claim with Abbey was acknowledged today (started on 19th April), and MCCOL say they have until midnight of 22nd of May to defend. I hope they 'forget' to defend and I win by default, but from what I've read about Abbey, they'll defend in the final hour.January GC £38.35/£1500

Well, Nastywest acknowledged my claim today, so now have until 20th May to either put in a defence or pay up (MCOL says they have 28 days to file a defence from the date the claim was served on them). I just know they'll drag it out to the bitter end

Looks like we're both in the same boat..........FatWest acknowledged my claim today. My 28 days are up on the 19th May (which is a Sat)......so after speaking to the MCOL helpdesk, NW have until the 21st to reply due to not being able to process the case on a Sat.
Fingers crossed
Anyone else??0 -

Does make you wonder if they have some 'system' for deciding which claims they will settle, acknowledge or defend. Maybe they have some numbering system.... ignore number 1, pay up number 2, acknowledge number 3, defend number 4, send additional snotty letters from Cobbetts to number 5.... then back to number 1 again. My money's on me being a '5' :rotfl: Bring it on Nastywest, I'm in the mood to take this all the way, and you WILL pay up

Hi....
Started the MCOL procedure against Lloyd's Tsb and claim was issued 19/04/07 and it still states start.
I know they have 14 days since claim was issued to enter defence/acknowledge etc, i just need to know is it 14 working days or 14 days total?
If my calculations are correct then the 14 days will be up by midnight tonight??
If anyone can clarify this I would be most grateful!!

Hiya - its 14 days in total, from the date the claim is deemed served (which is 5 days after the claim's issued)
If your claim was issued on 19th April, it would have been deemed served on 24th April, so 14 days on from that is 8th May, by my reckoning. You can ring the MCOL helpdesk for confirmation of that (if any of those dates fall on Saturdays or Sundays, then it's adjusted e.g. to a day later).
