Abbey have sent me a copy of their defence that they say they have filed on the 11 April, ( MCOL still reads claim acknowledged) but as I have not heard anything further can I file for Judgement by default as the 28 days is up from the date of acknowledgment? (Yesterday)(MCOL allows me to press the judgement by default button) Sorry if I appear thick, just don't want to get it wrong!0

Barclays had logged a defence on my claim. I got a letter from MCOL saying that my claim will be transferred to my local court. I have not heard anything in a few weeks and am not sure what happens now? Is there anything I should be doing?:heart2: Cookiepops :heart2:0

I'm now at at the MCOL stage. Can you add on charges that weren't covered in the original letters to the bank?
Also can you add on any charges that are due to be debited in the future?
Yes you can add on charges right up until you actually file the claim and any pending charges. From there if you wish to alter your claim there are instructions how to here :

I think you just need to sit tight now and wait to hear from your local Court - I don't think they send out allocation questionnaires any more (which ask for more info) as the Courts know that the banks never show up to defend in Court. You'll probably just get a date for your case, I'd think.

Hi to everyone... a quick question to those of you who have already filed with MCOL.... Which address did u put for the Woolwich? I have been using the Clacton-on-sea address for all my letters, but I don't think this is the correct address to use for the claim.
I did also read somewhere (on this thread maybe!?!) that someone had their intial claim rejected because they used the wrong address...

My MCOL claim was served on Natwest on 22 April - had no response online so far, and they have until the 6th May to respond.
Yesterday I received a letter saying they were offering me a 'goodwill payment' (an amount which equals the charges I've reclaimed)
I rang Natwest this morning to say I would only accept it as part settlement of my claim and without prejudice, but would be pursuing the rest through the Court. I got a snotty 'well, good luck to you, but that's our full and final settlement' !! I replied 'I won't need good luck as you WILL have to pay me interest on the charges you took from me unlawfully, and my court fees'.
I double checked with MCOL - they said I was absolutely right to say that, and that if Natwest don't reply by 6th May then I can apply for judgement by default.

My 14 days are coming up on the 5th May. I called MCOL helpdesk yesterday to ask when Natwest have until I can ask for a Judgement by Default. Basically, because its a weekend and also a bank holiday, I was told that they have until Midnight on Tuesday. I've got it marked in my diary to called them back next Wednesday at 12pm.....fingers crossed, they wont put in a defence.......................... :eek:0 -

Well...... HSBC have issued a defence which i guess means there isnt going to be a speedy resolution to this, is it just a case of sitting back and waiting now?0
