    My 28 days expired today for the MCOL claim i have ongoing for First Direct. It says "The Defendant disputes the whole amount you have claimed. Your claim cannot proceed online and will be transferred to the appropriate court for continuation". This is a new one on me as the others have just paid up. :o What happens now exactly??

    I have filed my claim against Abbey with MCOL and received a letter from the court to say that Abbey were defending the claim. That was 28 days ago.(claim was acknowledged 2 Apr 2007) I have received nothing from the court since nor have I received anyhting from Abbey. I have gone on to the MCOL site and they say I can request Judgement by default etc. Can I do this as Abbey do not appear to have entered their defence or do I have to wait to hear from the court?

    Any help would be greatly appreciated!

    Enter judgement by default as soon as possible ... I gather you are then taken to a few other screens where you have to reiterate your details.icon7.gif

    Hi there, im currently claiming through MCOL £366 from Capital One

    they have refunded me £88 on my card directly

    do i put in the "amount claimed" for the difference they owe me now, i.e. £278, sorry if i sound thick :(

    any advice would be appreciated as i want to complete this claim asap :)


    infact as im wishing to claim interest now, does this interest amount also go in the "amount claimed" feild?

    according to the interest calculator, on £366
    the interest is £132.54 :O

    that does seem really high

    can somebody please check to see if this is right for me please?

    and because the refunded me £88 already on the card automatically, im not sure how to take that into account with the interest calculations

    Mornin all,
    Quick question - moneyclaim went in and now shows an issued date of 18/4/07 which is the day after I paid. Status is currently issued. When can I start the judgement - can I do it today or do I still have to wait another 5 days?

    Can someone tell me what figure do i put in for my claim i originally asked for the bank charges plus interest but that interest would have been what it was 28 days ago. Do i re calculate the interest or do i submit what is was 28 days ago and they then recalculate the added interest or do i just ask for the bank charges fee. i have no idea

    Just to re-iterate, I checked and found that Abbey have sent me a copy of their defence that they say they have filed on the 11 April, (and MCOL still reads claim acknowledged) but as I have not heard anything further can I file for Judgement by default as the 28 days is up from the date of acknowledgemt? Sorry if I appear thick, just don't want to get it wrong!

    My MCOL claim was served on Natwest on 22 April - had no response online so far, and they have until the 6th May to respond.
    Yesterday I received a letter saying they were offering me a 'goodwill payment' (an amount which equals the charges I've reclaimed)
    I rang Natwest this morning to say I would only accept it as part settlement of my claim and without prejudice, but would be pursuing the rest through the Court. I got a snotty 'well, good luck to you, but that's our full and final settlement' !! I replied 'I won't need good luck as you WILL have to pay me interest on the charges you took from me unlawfully, and my court fees'.

    I double checked with MCOL - they said I was absolutely right to say that, and that if Natwest don't reply by 6th May then I can apply for judgement by default.

    I loathe Natwest :mad:

    I'm now at at the MCOL stage. Can you add on charges that weren't covered in the original letters to the bank?

    Also can you add on any charges that are due to be debited in the future?
