I'm with Lloyds TSB - claiming for £440 (with interest and court fees is £500 and some change).

The date for the bank to refund my charges is up on Wednesday, i've a few questions before I submit my claim through the courts
1. I'm on benefits how do I get fee exemption on line, will I have to submit a copy of my benefit via post????
2. At what stage do you have to get a court bundle together i.e copies of the paperwork to the court/defendant?
3. Once you submit the claim on line - does the claim on line keep a track of timescales, does it tell you when the dates are up for the next stage?

Have a read of Martin's step-by-step guide on the home page (reclaiming bank charges). Also look at the CAG web site, which has all the legal info. you'll need :-

Yes, if you claim online, MCOL will show you on your claim page when it's acknowledged, defended, etc., but bear in mind that, if your bank do defend, MCOL then finishes and it's all dealt with by post.Wins since 2009 = £17,600MANY THANKS TO ALL OPS0 -

I sent them an e-mail and got this back:
Thank you for your e-mail. We are aware that the online system had a 'glitch' for a period of time and has incorrectly dated a number of claims.
The online and court systems will be corrected and a corrected claim form will be sent to the defendant so that they are aware of the correct response times.

i have filed my claim with money claim and it has now been accepted and i entered the start process and it is asking me
1)the defence has not filed a admission or defence to my claim
2)the defendant admits that all money is allowed
what do i do here. do i fill it in now or after the 14 days are up.

Hi everyone,
Just need some clarification on when i can issue a judgement by default, i am claiming £1050 from HSBC, the date on my claim form says issued 30/03/07 (31 days ago), HSBC acknowledged the claim on 03/04/07 (27 days ago). could anyone tell me whether i should issue a judgement by default yet.

So this Friday is 28 day default judgement deadline, but Halifax have settled in full and all monies received. Do I have to do anything with Moneyclaim now, ie. stopping paperwork etc, or can I just leave it?0

Once your money is safely banked, you should cancel MCOL to cancel the claim. If you have trouble doing it online, just give them a ring
