  • I filled out the claim form on moneyclaim to claim my charges back from hsbc. I have just been online to check the status and it says that it has been acknowledged on 24/04/07 and it was issued on 20/04/07, it now says that HSBC has 28days to reply to this from the date it was issued. What happens next should I expect a refund within those 28days as Im worried now that it will go to court ?

  • I have processed my claim against HSBC on line with MCOL and i am now very concerned!
    I followed Martin's template and it didn't advise to put my account number on.Stupid now that I think back to it but now the claim has been processed!
    I didn't think anything of it till I came across other threads where people have done the same thing!
    will my claim come back rejected by the Court now?
    Is there anything I can do?
    Has anyone else done this and it has turned out ok?
    One thread mentioned being charged an extra £100,I struggled to pay the £80 fee.
    Please help

    If you have questions regarding your particular claim, phone up MCOL or email them. Have a read of the FAQ here... http://www.hmcourts-service.gov.uk/cms/1051.htm

    As regards the timing on MCOL, please read Beate's post on the Reclaim Help Thread which is linked in my signature along with a post about further cost costs and a link to the relevant website.
  • Hi guys,

    Ive decided to apply to the courts by post as I had trouble trying to pay by card on mcol. I rang my local court yesterday afternoon and spoke to a very nice lady. She said she would send me the forms that I need to fill in. They arrived today!!!. Funny how bank letters are never that quick!!!.

    Anyway my question is?
    Brief details of claim: Anybody know what correct wording I should put in this space? I know what to put in poc (have read post 6). But not sure about this bit.
    Any advice greatfully received.

    Has just occured to me that when filling in the claim with MCOL if the registered address of the bank is used as opposed to the branch address, then the sort code will need to be entered as well as the account number.

    I'm pretty sure that if they have the account number ( a unique number), then the Bank will be able to identify the customer. I'm sure MCOL wouldn't accept the claim request if there was insufficient information

    I posted this on the Natwest thread but thought it may be quicker to get a reply here.......After Natwest denied to have received any letters from me, I began MCOL, to which they have acknowledged & their 28 days will be up on the 8th May.
    Today I received a letter from Stuart Higley saying he would refund the £129 charges....hmmm!

    I would like the £30 court fee refunded & I've seen some people get interest back too whilst in the MCOL process (though I know I'm not entitled to this yet)...what's the best way to go about this, call him & discuss it or write to him...any advice appreciated.

    If you have started MCOL then you ARE entitled to the interest and court fees so write them something back along the lines of

    I cannot accept your offer of £xxx as full and final settlement of my claim. I will accept this as part payment and without prejudice, but will continue my claim for the balance. I have made a reasonable effort to settle this claim before issuing a court claim, but you ignored my efforts to settle this. Seeing as I have now had to issue a court claim because of your failure to deal with my claim in a timely way, I will now settle only for the full amount of charges+statutory interest+court fee.

  • Hi Can anyone help please? Am about to start a claim on MCOL. Am trying to claim back charges on 2 accounts from HSBC, one joint and one sole. Is it possible to do under one claim, therefore only paying the fee once? Or do you have to file two separate claims? Any advise would be great!
