    Hi James21

They have 5 days to serve it and then 14 days from that to acknowledge. That means they have until midnight of 27th of May to acknowledge. That's how I undrestand it anyway! Good luck.;)

Acknowledging gave them an additional 14 days to react so sit tight and if they don't defend you can enter judgment by default. If they do defend the court will tell you what happens next.

Not a stupid question at allicon7.gif Have your bank defended the claim yet (it will say defended on your claim page and you may have received their defence)? If they have defended, the online claim stops at this stage anyway, so no need to do anything.

If not, I believe you can stop your claim on the MCOL website. Personally I'd give them a ring anyway to advise them.

    Congratulations by the wayicon7.gif

    Hi
I have a problem with Capital One, with a total claim of £1022 they offered me £328 as a settlement, which I wrote back and accepted as a part payment and said I would take them to court for the rest, this is what I did, using MCOL (£694). but now they have told me they are not going to pay the £328 because I didn't settle!!!!
So I'm in a situation where I have put in one claim for £694 and have will have to put in another for £328, dose any know if this is possible?

Phone MCOL and ask them about changing your claim it will cost £35 but cheaper than starting a new claim.

Just done that, they said it would be cheaper with a new claim, this would cost £50 compared to changing, which would cost £35 + my old claim goes over £1000, so costs change from £80 I paid to £120 for claims from £1000 to £5000, so in total it would cost £75 to change.
So it looks like Capital One are going to pay £50 more for messing around.:rotfl:
