just filling in the form for the courts and im stuck:confused: its the last bit on the following paragraph about daily interest can anyone tell me what this is.

The claimant claims interest under section 69 of the County Courts Act 1984 at the rate of 8% a year from {date when the money became owed to you} to {the date you are issuing the claim} of £ {put the amount} and also interest at the same rate up to the date of judgment or earlier payment at a daily rate of {enter the daily rate of interest}.

    hope someone can help!!

I've just checked and the daily rate is actually .00022, not as above.
    Wins since 2009 = £17,600

    MANY THANKS TO ALL OPS

I filed a claim against Alliance and leicester and by my counting my 14 days are up, this includes the 5 they have allowed to process the claim or what ever,

Is it 14 days or 28 days the bank has to respond? The have not acknowledged my claim yet so I phoned the court and told them this, they said its 28 days the have to acknowledge and if they don't I win by default or something.

I'm in Northern Ireland, So unless it works different over here, When I phoned the court I asked had they responded and they haven't so I don't know whats going on.

they have in theory 19 days to acknowledge (5 for papers to be served and 14 from this date) - if they dont acknowledge or put in a defence you can get a judgement which means you've won

if they pu tin defence / acknowledgement (as they all do) you then add an additional 14 days onto the claim (from original issue date) - therefore total of 33 days - hope this makes sense

As soon as the money is in your account, you can go on to the MCOL site and I think its self explanatory how to close the claim - am not up to that yet, so not 100% sure. I wouldn't close the claim until the money is actually in your account, if I were you.
Are they paying you interest and your court fee as well as refunding your charges?

HI frugalpam - thats great, I will do that once the money in my account has cleared. It was only a couple of hundred pounds but yes I got the lot including interest and the court fees. Problem is they initially offered me £100 which I had turned down - now they say in their letter they paid £100 into my account and were basically now paying the difference. I am going to have to call them because 1. I turned down the £100 so what the hell were they doing paying it anyway and 2. I closed my account with Halifax almost a year ago so how am I going to get the money?
I wont be closing any court claim until the money is cleared in my new current account!
    Thanks

    Thanks in advance

    HI

I started the MCOl process in January and my claim has been wit the local court since the 19th Feb with still no hearing date. Has anyone else had to wait this long?

Currently, my claim says Claim "Issued", Judgement "Start" & Warrant is blank
I have a couple of questions, if someone can help that would be great

    1. How do I know when the bank has received the forms?

    2. When do I start "the judgement"?

    Cheers
  • Hi,
If anyone could help I would also find the information useful as I am in the same position.
