Hi guys,
A bit of advice please : I'm claiming bank charges on behalf of a relative and have just started court proceedings. She asked me if it was a good idea to transfer all direct debits/standing order to another bank account she has in case the A&L close her account, to which I replied, yes, it's probably a good idea. However, her other bank have advised her that, in order to do this, they need to close the A&L account and looks like they've actually started this process.
Do you think this will matter?
Any advice much appreciated.

just go with the flow apparently in most cases the bank pulls out in the last minute. if not the court will rule in your favour0

My claim was aknowledged 2 days after it was issued.......does that mean i have to wait even longer now as i presumed it was 28 days after the aknowledged stage?!

It was the same for me. My claim was issued on 21.03.07 and acknowledged on 22.03.07 - I thought the 28 days would be up on 18.04.07 but on the original paperwork it says the claim is deemed to be served on 26.03.07 which means the 28 days is actually not up until 23.04.07 which is this coming Monday!

PoC = Particulars of Claim. Some Courts are now chucking out the cases pursuant to CPR Rule 16.1 (basically no substantive case) unless more substantive particulars are given.
I'm just about to start MCOL against Lloyds, I'm wary of this CPR Rule 16.1 can anyone help me with some advice, is it still ok to use the script in post 6 of this thread or do I need to be giving more detail.
Sorry if this has already been covered but like quite a few others I'm getting nervous now its reached MCOL stage, I dont want this case thrown out on a technicality.0 -
hiya, im just starting my claim with MCOL ive issued the letters as per the step by step guide, the last correspondance from them said they were investigating and would reply within four weeks. so ive decided im not waiting that long . Quick questions, if I start the claim and pay the £30 to the court and Halifax make me an offer will the money be refunded or will i lose out cos i didnt wait for their reply? Also as its a credit card is there any different procedure? how do i calculate interest? Help please!Reclaimed Charges £2433

Once you file a claim you are entitled to interest and court costs so you will get it back. There is no different procedure for credit cards. You calculate interest by inputting all your charge amounts and dates in the interest calculator in Martins "Reclaim Bank Charges" Thread on the home page.Reclaimed thanks to this site:
