Thankyou for all your support, I have no news as yet, saw ex's new partner taking MY son to achool today, that was a little upsetting.
I have to hand all my documentation in to solicitor to see if we qualify for legal aid, had a look online and it said no!official dfw nerd club member no 214

cattie, hard to say but try not to worry about the money - get this started and get your boy home, the RO you can go for yourself.

Nothing until I had in the documents, then we go for emergency residency orderofficial dfw nerd club member no 214

No, according to him "Thursdays and Saturdays are "my" nights"! except last Sat he wouldn't send him cos of the solicitors letter.official dfw nerd club member no 214

I've phoned the school and explained the situation, I don't think they want to get involved and as I have just moved children there I dont want to cause a hassleofficial dfw nerd club member no 214

At the end of the day they should be keeping an eye on the boys as they will be involved sooner or later with the RO being applied for. They will approach the school for statements too. Keep us updated when you can, we will all be thinking of you on here. x0 -
Just an update.
I let the boys go to their Dad for their usual Friday night, I then went to pick them up 3pm Sat as usual,
The ex demanded DS2's uniform, which I took but he refused to give me DS1 's(who lives at mine all the time?) uniform, schoolbag, packlunch box/bag etc, (everything we have paid for), saying he would bring them when he came to pick Ds2 up on Sunday morning (Saturday is "my" night with DS2)
-I didn't think much about it at the time, but when he asked what time to pick Ds2 up I said 4:30pm he said "no, I'm picking him up at 10:30am, he then rang at 10am Sunday saying he was on his way, so I said DS2 had asked to stay another night at mine, he then started swearing and name calling down the phone so I told him not to bother coming as both Ds would be staying at mine.
During this time Ds2 had asked if he had to go to his Dads and his eyes welled up when I said his Dad would be coming for him soon, he then "hid" between 2 chairs(-I didn't notice this but my partner asked if I had seen what he was doing),He turned up at door at 10am, rang doorbell, phoned numerous times, banged door for around half an hour while I ignored him!
(I sent kids upstairs before he arrived so they couldn't hear any of it.)
When he had left I told Ds2 that he could stay at mine another night and he shouted "yeay freedom" I know children say funny things but it just seemed strange.
I'm not sure if this now makes me as bad as ex though?
Today I went into each school and asked the secretary to ensure that only I could pick the children up, I got a different one to the usual nice one at Ds2's school who said she couldn't stop him from picking him up unless I brought her some paperwork.
I tried contacting solicitor but once again he was in court,m and I was told he would call me back-I'm still waiting!!
I then asked if I could pick both children early which was agreed to and work let me leave early, when I got there, I text ex to inform him I had picked children up he told me Ex's new partner was there so I "better let her pick ds2 up"-I refused.
All night I have had him calling my mobile-but ignored it, he's also sent a text saying he will be going into school early 2moro to pick the boys up, I don't want to keep takingn them out of school early and certainly don't want to keep them off but I'm not really sure where I go from here or what I can do.
I'm also not impressed with solicitor-is it normal for them to be so hard to get hold of?-I've never used one beforeofficial dfw nerd club member no 214

Ok, I'm no expert and never been through this but if I were in your shoes I would keep the boys off school, ringing the Head to explain why. Then you need to find a solicitor who will get you an emergency residency order ASAP. You just need to plague the life out of the one you have until they get back to you or consider trying someone else (although if you've a good one who is busy I guess it shows they are good,). I don't know what else to say, but I think that as long as you keep the school informed the a couple of days off schools going to be preferable to them to having you and your ex embroiled in battles over collecting them every day.
