Very good......but what would stop him from doing the same thing the following day and picking up both boys?

You could stop it by making it VERY clear to the head teacher and the class teachers of both children that they are to leave the premises with you and you only! The school office staff should also be made aware - they are the first port of call in a school for all visitors. Give them letter stating this, follow up with emails and phone calls to make sure they are clear on the procedure. And of course, tell the children too!

Good luck with it all - I've been on the end of an abusive ex and it's horrible - best thing I did was to realise he no longer had any hold over me and start standing up to him!

Ds1 before then-hence the reason he hasn't taken him, DS2 after then which is why he kept him and I said nothing I could do (for now) legally, but thank-you for the info.
Sorry. I thought he'd taken your eldest child, not the youngest. How awful.:( I can see why your other son is so upset, many older ones feel very protective of their younger siblings and how manipulative to work out which one he could do this to. You def need good legal advice and asap.

Tomorrow is too late for what can be done today.........get out there girl and get your child back, you will find you will get a toughness you never knew you had..
It is nice to see the value of your house going up'' Why ?
Unless you are planning to sell up and not live anywhere, I can;t see the advantage.
If you are planning to upsize the new house will cost more.
If you are planning to downsize your new house will cost more than it should
If you are trying to buy your first house its almost impossible.

I didn't know that, I'm not very good at thinking fast though!

You won't be by yourself we can help. What is your situation financially as you may be entitled to help.
Mama read so much about the dangers of drinking alcohol and eating chocolate that she immediately gave up reading.

Last time I went I was living on my own and earning less than i do now and was told I was £20 over than the amount you need to be earning in order to get legal aid, I will be asking 2moro though.

I would just like to thank everyone who has replied, it has helped me cope and some very good points have been made and made me think.
I'll let you all know the outcome of solicitors 2moro.

I think you need an emergency court order. Speak to your solicitor about getting one ASAP - it'll go through quicker than a normal one and will get the little boy back in your care while everything else goes through the courts. However much you have to pay for this initial hearing it will be worth it. THEN get a residency order so he cannot be removed from your care. You can do this on your own although CAFCASS will interview the children so it'll not be their word against yours.

As the father has PR and there is no CO in place, he is free to remove them from school as well as the mother, she NEEDS a residency order. They take ages but at least get an emergency hearing in place now so you can get him back into your care. The sooner you get moving on this the better.

Let us know how you get on. Your DS is crying because he is missing his brother - he might also be concerned that he could be taken too. You need to inform the school so that they can keep an eye on his if his work is starting to go downhill. Go in and ask how things are.

Solicitor cancelled tonight as he was stuck in court anbd re-arranged for 2moro :(

I bought my son some worry dolls and gave them to him tonight, he told 1 a worry, at around 5pm, at 8pm I asked if he had worried since telling it-he said no :)
I've also bought the book that was recommended and a dream catcher and he is really happy about dreamcatcher as he keeps having "scary dreams"

Hi, I hope the worry dolls and dream catcher help your son - sounds like they have a bit already. Best wishes x
