    Nowhere in my reply to you has there been any attempt of any defence, whatsoever. All I asked was why you hadn't asked the sender to make enquires on your behalf. You have not only paid for the contents of a parcel, you have paid the seller for the items you have bought and for them to deliver the goods to you.

    Yodel's commitment to their customer, the seller of your goods, was that they will deliver them within 3-5 working days. At the time of you writing you original post that time had not been exceeded.

    If the sort of attitude, which you have demonstrated here, was used with your seller or with Yodel, it is no surprise that you are drawing a blank.

  • If this were a game of Yodel Trumps then I think I win.

    I bought via the bay a part for £900 and the box was 5 feet by 2 feet, so not the sort of size to fall behind the seat.
    This was in collected by Yodel on 7th MAY 2015, it is now JANUARY 2016 and I still do not have the parcel.

    My problem was that although I paid for the delivery the seller organized the collection, this means that all the seller has to do was say " yodel collected it " and then the seller is out of it.

    So you call Yodel ( if your lucky and they answer ) only to hear them say that they cannot talk to you because of the data protection act. ???

    So, the seller is out, and the Currier is out of touch, and the buyer is out of £900.

    The police have confirmed the seller posted it and that Yodel has the parcel, then they are out ???

    Hang on, you now know where the parcel is and you walk away, ? I involved you because I couldn't get anywhere with Yodel. The police said its civil, WHAT, they have my goods and WILL NOT give them to me, in the end the police stopped returning my calls.

    I did a search for YODEL email address for customer services and found this forum, so if anyone knows the email address please let me know.

    Because of the cost I will keep going even if it ends up in court.

    I spoke to a driver and he said if the box is damaged they will not deliver because if the customer makes a claim it is the DRIVER who has to pay, and the money is taken out of their wages, so if a box is damaged, the driver says NO, and there it sits for 8 months >>>> forever.

    I have only last month been given the details from the police that is why it has not been resolved yet, but a CCJ should wake them up a bit, lets see.

    You say you paid. Did you actually pay Yodel?

    There are a number of points to consider here. First of all, from what I understand, it seems the size of the parcel may have been outside that which Yodel allow. So, it is entirely possible it got lost in the system that sorts outsized parcels. Not a good excuse for losing parcel, but nonetheless, it could still be the reason.

    Secondly, you purchased the goods from a seller, who organised the delivery and paid the courier. Therefore, there is no contract between you and the courier. That is the reason why Yodel told you they couldn't discuss it with you.

    Thirdly, the seller has a responsibility to deliver the goods to you, they clearly haven't. So, the dispute is between you and the seller, not Yodel.

    Which raises the next point and that is, if you are intending to go to court over this issue, the only party you can sue is the seller (a much less cumbersome option than suing a multi-million pound business).

    I don't know about the driver you spoke to, but I think he might have been having a little bit of a joke with you. I am not aware of any contract of employment, or terms of trade that would include such penalties. Something like that would have to be dealt with by the courts. It would very much depend on evidence as who caused the damage and any reasonable care that would, or would not, have been taken.

    But, I find the involvement of the police to be most perplexing. I cannot see why the police would be getting involved with such a issue. For example, what crime would have been committed?

    This is a civil dispute, between you and the seller of your goods. The police do not usually involve themselves with civil matters. Perhaps they were stringing you along, in order to look like they were doing something.
