Hi all! Just wondering if anyone's had a delivery from CPW yet? My order status finally changed to processing yesterday and said it should arrive today but it's not changed to dispatched yet! Should I just ignore the delivery date? Thanks!
I got a text last night to say my order had been despatched and given a tracking number, had a further text today to say that its on its way, just checked yodel with tracking number and its out for delivery, money went out of my bank yesterday afternoon, first text arrived at 8.30 last night after I phoned CPW, who told me that it had been processed and again said anyone that has an order number is getting their order, he was also in the same boat as he was waiting on his order being processed!0 -

If they are going to sell at the discounted price then why not just refund the difference now for those with it in their possession or implement a refund, buy back scheme where I can take it back and immediately buy it back at the new discounted price? Surely that is their easiest option...right? Maybe I am missing something.

No, the DSR are a travesty of eCommerce. They were contrived by an EU committee who appeared to have little understanding of how distance selling really works. I suspect that this may be due to the fact that eCommerce was not as sophisticated throughout the rest of the EU as it was in the UK back when they were drafted.
There is no compulsion to return goods under DSR. It provides an unconditional right to cancel the contract for a refund of all costs. This gives brick and mortar shops an unfair advantage over webstores in sooo many ways. It boils my blood.
Evil consumers are using DSR precisely to acquire goods on approval, a purpose for which the regs surely cannot have been intended. This is why you now see more webstores offering 14 day returns. If they can get you to make your return outside of the 10 day DSR window, they can call the shots on the returns process instead of Brussels.
The DSR seriously needs overhauling because at present it overempowers consumers which could ultimately have an impact on prices online.0 -

My husband had an order number from CPW, ordered around 7.20pm Monday night. He received an email yesterday afternoon to say his order had been cancelled due to no stock....they are however holding the money from the credit card....... we are puzzled.0 -

My understanding of the Distance Selling Regulations is that anything returned under those rules must be in an unopened/as-new condition so a retailer can resell the item as new without loss to them. The reason the DSR allows returns is, unlike in a shop, you can't look at the boxed/packaged item prior to purchase and assess suitability, it's to try to place the purchase on an equal footing to one made in a shop, not to give people an opportunity to try-reject-return.

No, the goods must be looked after. You may open the package to inspect the goods including turning them on, as you might be able to do in a shop (shops have one on display usually). From the OFT's website:
"How can I resell the goods as new if they have been opened
and tested by the customer?
3.59 The DSRs do not provide any general exception to the right to cancel
on this point. Unless one of the specific exceptions referred to above
at paragraph 3.38 applies, consumers can exercise their right to
cancel a contract and return the goods to you. The DSRs do not link
cancellation rights with a supplier’s ability to resell items as new."
