    looks like that's going to be the only avenue to pursue, this is the only response i'm getting to any enotes on the topic now:

    Samsung 28” Pure Flat Widescreen Television.

    The price advertised of £28.08 excl vat represented in law an “Invitation to treat” It was not an offer to sell the Television.

    It was obvious to all concerned that the figure given was incorrect. Our Terms and Conditions permit us to decline to supply any particular item. In this instance no contract was made and this company has no liability to you

    Our local Trading Standards Authority has been notified of the error, you therefore may wish to take advise from the local Authority, or from your solicitor before taking this matter any further.

    It wasn't obvious to you 'effort' to check prices are correct on the website, such a massive difference shows no effort can be made at all to check prices are correct.

    Term 2.3 begins with:
    "Every effort is made to ensure that prices shown on the Supplier’s website are accurate at the time you place your order."

    The fact that this price was allowed to go live on the website shows how little, if at all any, effort is put into showing correct prices.

    Quote:

    Accorfing to term 1.2:
    "1.2 No contract exists between you and the Supplier for the sale of any goods until the Supplier has received and accepted your order and the Supplier has received payment in full (in cleared funds). Once the Supplier does so, there is a binding legal contract between us."

    A contract WAS made according to term 1.2. This is because you had received all funds requested, as shown on my credit card statement, and you had accepted the order - according to term 1.3 'acceptance' is termed to be having taken all funds and recieved an acceptance email from yourselves - both of which happened.

    Can you please tell me where your terms and conditions explicity state this. This is just for my reference.

    I will be taking this matter to my local trading standards in due course for further clarification, but could you please respond to the points and questions raised if it is possible for you to do so.

    I will be contacting trading standards about this issue later in the week and see what happens from there

    just checked my statement and they have refunded my my money but the money did go into ebuyers account which means that the funds did clear so they have broken the T&C

    MSE LURKER is UNBELIEVABLY sad - going to the effort of actaully fabricating a letter from Ebuyer and passing it off as one he's received.

    GET A LIFE

    I think the only way we are going to settle this is take them to the small claims court. Obviously give them every opportunity to come to an agreement. biggrinclarifils.gifhush.gif

    However there Terms and Conditions are worthless, they dont even abide by them, themselves. Shame on Ebuyer angry4.gif
