    http://www.ecominfo.net/arts/econtracts_warchus.htm

    maybe of interest to people

remember when reading though that Ebuyers Terms and Conditions 1.2 and 1.3 clearly state the acceptance e-mail It is at this point that a binding legal contract is created and any contract is subject to these Terms and Conditions

which is a different case than that in the article :)

The price advertised of £28.08 excl vat represented in law an “Invitation to treat” It was not an offer to sell the Television.

It was obvious to all concerned that the figure given was incorrect. Our Terms and Conditions permit us to decline to supply any particular item. In this instance no contract was made and this company has no liability to you

Hummm....I've a few other orders on the go with them, before I bought my tv which they have now stolen....I wonder if they will make me honour my outstanding purchases if I tell them I want to cancel them as they are yet to be delivered and their email clearly states their Terms and conditions mean no contract is made even when they have taken the money

I was speaking to my solicitor today actually and ran the idea past him and his opinion was if it was a business->business transaction ebuyer might get their shoddy T&Cs through, but consumers are usually better protected (he couldn't officially comment as he hadn't looked at it all in depth, just a passing chat).

I really feel them taking the payment sealed their fate and their dodgy T*Cs wouldn't hold up in court. The only risk is if the court decides it is a genuine pricing error and throws it out.

If someone has the time and inclination to do it I think it would be a fantastic idea to take them to court and I for one would throw in some cash.
