    If someone has the time and inclination to do it I think it would be a fantastic idea to take them to court and I for one would throw in some cash.

    Ebuyer's argument is obviously going to be that a) the price was an obvious mistake and b) that there was no contract:
    It was obvious to all concerned that the figure given was incorrect. Our Terms and Conditions permit us to decline to supply any particular item. In this instance no contract was made and this company has no liability to you
    Although technically they would have probably been better to argue that there was no contract and even if there was there was a mistake, since to destroy their argument at the moment all one need do is prove there is a contract which is a lot easier.

    However, there are several counter arguments. Firstly, with regards to the price being an "obvious" mistake. The words used by ebuyer were "For A Truely Unbeatable Price !!!!!!!!!!!", this implies an extraordinary offer and an amazing price and clearly gave that impression. Furthermore, if it was "obvious to all concerned" what could everyone have expected to gain from this: there was some expectation of it being a legitimate offer. Also the prices of televisions have dramatically fallen recently, helped to some extent by low priced electronics in supermarkets, and the average consumer cannot be expected to have full knowledge of the exact price of a tv - if one had thought that the tv set was only really worth £100 or there abouts the advertised price would be great but not unbelievable.

    With regards to the "no contract" argument - no judge in their right mind would conceed that point and they are seriously ill advised if that's what they are trying to argue. I think it's fair to say that you'd have to be an idiot to think there's no contract after the order has passed through all the following steps and passed the point where the buyer has the right to cancel: a "Security Check", "Order Placed", "Goods Allocated", "Payment Taken" and informing the consumer that the stage is at "Pick In Progress". It is clear that ebuyer intended that the offer was a contract by that stage but are simply arguing otherwise as it proves convenient to them: which raises the point of whether it's actually possible to have a binding contract with ebuyer at all (since according to their argument they can always simply state that there is a "mistake" and no contract). I'd go as far as suggesting that these steps, whether taken consciencously or automatically by a computer, are enough to establish consensus ad idem (meeting of the minds) and that both parties intended negotiations to be final and the contract settled and binding.

    I've more or less been told by the muppets of the enote system that they're not going to give me any more information and it was suggested i wouldn't get anywhere further by writing to them either. So i guess the balls in our court.

    Ok perhaps now is the right time to point out I actually bought a Ferguson 28" widescreen in the argos sale in December, now I know little about such items as I am normally to tight fisted to spend more than a tenner in one go!
    I really don't see why armed with that information I should have questioned the ad to be anything other than what it purported to be "an unbeatable bargain" I certainly think it was, that having been said if someone had offered me the same "unbeatable bargain" in say a pub? or maybe in the dole office! I might well have cause to question the legitimacy if not the bargain, but no, I saw the ad on the ebuyer web site which is well known for both its excellent prices and s**t service, the only question for me was do I risk the s**t service for the bargain?

    What does my having bought a Ferguson in Dec got to do with anything?



    £105 with £10 gift vouchers total price after vouchers considered £95 now thats a bargain but £33 with stand and built in freeview now that's what I call

    "an unbeatable bargain"

    I think a decision needs to be made sooner rather than later as the longer its left the better it looks for them........

    But i must admit it was truly a good bargain as Ben says :D

    Just got in and opened my emails to find one from ebuyer with my order no advising me that in addition their wonderful enote system - they still have a contact telephone no.

    I don't recall seeing any telephone no on their site over the past few days. Wonder why they have suddenly decided to impart this piece of knowledge now. Methinks someone is trying to get their house in order "just in case."

    Sorry if it has already been posted - I'll have my dinner and catch up with the thread.
