  • Firstly I am stunned. Not by the "alledged price of the TV" but how everyone is causing a frenzy over a pricing error. Look at it this way - we are all human and mistakes occur. We've all dropped clangers in our time and this guy who set the price has probably had grief from his bosses over the last few days. What I find hard to believe is the playground behaviour and the "greed" and the lengths some people are going to - talk of hiring solicitors etc etc. Surely you have something better to do with your time. So out of the 200 people or so who claimed to have purchased a TV do you think that everyone is going to stump up money to fight this in court?? I dont think so, pages and pages of threads talking of suing the company, travelling to the offices, all in all its just talk at end of day - did you really expect to get a brand new TV for £33?? If so then you are living a fantasy world. Put yourselves in the shoes of the guy who cocked up - imagine it was you, would you still react the same?? I dont think so, and if you say otherwise then......

    It was an error and all you seem to be doing is the attitude I want it and I want it now, I purchased it at the price etc etc???

    Put it this way - if you sold a new TV on ebay and failed to set a reserve and it went for £10 when it was worth £300. The winning bidder paid by paypal and was awaiting delivery.

    Would you a) Refund Paypal payment and send email offering apologies as mistake had occured or

    b) Send out the TV at a serious loss to yourself.

    I will leave you with that thought.



    A message to Martin and board monitors: Whilst I understand feelings are high on this matter it is being blown out of all proportion and something needs to bring in back into context.

    Sorry jason.lawrie but I have to disagree with the content of your post and yes, if I was to sell something on ebay with no reserve then even if I was to make a loss I would honour the sale.

    Maybe if you searched and checked other items Ebuyer have sold at unbelievable prices your attitude would be different. Why would anyone disbelieve this offer when you see other offers they have run at ridiculously lower than low prices?

    Just as an example, I’ve done a quick check just on the MSE forum not using the search engine but just a quick scan on posts these are two I came up with straight away

    Ebuyer 80418 Grey Ps2 Wheel Mouse for £0.49, £0.58 inc VAT (still on sale

    Smart media Card Reader for 99p + Free P&P posted on the 16 February 2005.

    Now admittedly these are smaller items than a TV and would cost less in real terms, but can someone (Ebuyer staff) please explain to me how they could make profit on the card reader when it was 99p and sent by City Link carrier???

    They now have the cheek to try and say “It was obvious to all concerned that the figure given was incorrect.”

    Well thats ebuyer, I will try it again in a min but the last time I called that number it said sorry we stopped taking calls, contact us via our site.....
    If i were you I would reply asking them for a number that is actually answered as listening to someone saying go to the website is actually no help, love to see the response (I guess they will ignore you and close the note)

    That is a VERY good example. I personally would sell the TV at the price (although i can't help but wonder at your flawed logic - surely a better selling price would have been £30 or £40 rather than £10 - that might have made your point a little better than your poor attempt at exageration).

    I've quite a good feedback rating on ebay and have in the past sold things for a lot less than they are worth in order to maintain my 100% 'record'. Also i cannot expect buyers to pay promptly and keep to their side of the contract if i do not myself. But that's the difference between me and ebuyer - i care about customer service and people's opinion of me and i respect and adhere to the law (of contract).

    I think it is this that has annoyed a lot of 'us' and the reason why some of us don't feel that ebuyer deserve any leniency.

    I'll ask you a question - if a £30 item had been put up at £300 by "mistake" and someone purchased the item believing it to be good value, do you think ebuyer would be so willing to argue that there was no contract? I'll bet you they'd keep very quiet about it and never mention the fact that there was an error.

    I respect that you may have a differing opinion but i think your tone is more in keeping with your "playground" analogy. Indeed, "Jason" you're sniveling "A message to Martin and board monitor" seems a bit like you're a tell-tale. If you disagree, just disagree, there is no need to try and insult people.

    We live in a free-market economy which means ebuyer have the right to breach a contract BUT there are consequences for the breach. Companies seem to forget that because of consumers like you, consumers that are unwilling to exercise their rights, consumers that will let companies simply take the mickey and flout the law.

    Furthermore, i very much doubt the "mistake" and "error" were ever the creation of a single mistyped price. If that really is the case (which i find very difficult to believe) then there are seriously flaws with their system and they didn't take any precautions against this and it's their own fault for being so negligent. If it was a computer glitch then they could have insured against it. Either way - ebuyer haven't learn their mistakes from the past (this isn't the first time they've done this - although the last time they did offer free postage with the next order as compensation) and the only way i see them ever taking any notice is if people keep pressure on them.

    This Company has gone beyond the "Oh it was a Mistake Sorry" routine, they have played that card 1 to many times.

    Like I have stated before, its not about the TV its about standing for your rights and showing Ebuyer that they cant Just Push Customers around and do what "They" want, even when it breaks they "Own" T&C's
