My order has only just been cancelled.
My credit card was properly charged, not just reserved, and I have the amount on my statement. (ebuyer sheffield £96.82) (I ordered another item as well as the TV).0 -

As was mine. The payment wasn't merely ringfencing - they actually took the funds and had to refund it.
amit_1's Trading Standards letter is very interesting. It's also interesting that different Trading Standards are issuing different advice.
It'll be interesting to see what ebuyer say to them.
@amit_1 - is there any chance you could post the email address you've got for that Trading Standards - it's just rather than going through my local one who will only eventually pass if on to them.
I reckon ebuyer are actually a little bit worried about this. I've never seen enotes receiving a response so quickly and i've used them on and off for years (only with items that i'm in absolutely no rush for though - since they don't mind sending the wrong thing then trying to force you to pay the return postage and similar dodgy trading practices.)0 -
I also think Ebuyer are worried, never have I experienced in dealing with them for almost two years have they ever replied to an enote promptly, admittedly only enoted them a few times.
But the last 3 replies have been the next day and always polite. The first enote they did a confirmation that a reply would be sent and that it would take 7 business days. However, that wasn't the case at all.
We all know how bad this company is and often flout the law when it suits them.

I've just been told my order of two televisions has been cancelled from my order. I have not been consulted about this. As a result of this action I am now being charged £7.97 postage on two cables costing £1.78 (price plus vat). This is unnacceptable to me.

Anyway, I need immediate advice regarding how to proceed with the now unwanted cables probably heading my way. What's the best way to proceed? Just refuse delivery? I don't place much hope in them coughing up for the return postage of the cables.

The only way to ensure that Ebuyer pull their socks up on ALL their trading practices is for everyone who has a complaint to register it with their local Trading Standards Service. Most of the breaches are in relation to civil legislation, which effectively gives the individual consumer the right to challenge these practices by legal means. For most people, the amounts involved are small (e.g. return postage for wrong orders), and most individuals feel that taking action in the small claims court would be more time consuming than it was worth. For this reason, these breaches are able to pass unchecked by the authorities.
Trading Standards have limited powers unless they receive a number of complaints about breaches of civil legislation. If everyone complains about ANY breach to their local TSS, a record of these is kept. If a trigger number of complaints against any one retailer is received, either locally or nationally, this can allow TSS to take appropriate action against them. For this reason, every single breach of legislation should be reported, whether or not it seems trivial. It may be just the one extra call needed to stop a company in it's tracks.I haven't been asked to tell you that I'm the [highlight]Board Drunk[/highlight] for this board. Long time lurker - 1st time poster here -
Having just this afternoon read through this mammoth thread I would like to offer my opinion..
IF you were to take legal action against Ebuyer it would only be for "Loss of Bargain" and in order to take action for loss of bargain you would first need to purchase the EXACT same model from elsewhere and then claim for the differance. The important bit being YOU MUST PURCHASE FIRST..the model and any accessories must be exactly the same...any differance and you have no case..This will be a bit problematic for those of you who have ordered multiple items some I believe even ordering 20! The other precusor to the judge ordering the claim to be paid is that you didnt believe this was a mistake and you are not seeking to take advantage of a mistake..again going to be difficult for you when no doubt ebuyer have taken copies of all the forums discussing this.
With regards to the loss of bargain - I am speaking from experience having had a similar experience with SKYBUY about 18 months ago - I was successfully awarded an amount equal to my loss of bargain.
So there you go a few thoughts..0 -
I reported them last Christmas to Trading Standards because they took my money and they failed to deliver my goods even though I ordered late November then had over 3 weeks to delivery. I had a right hassle to get my money back and in the end I did a charge back from my credit card.
I had to do without Christmas present because they ignored my enotes 3 of them and on one occasion that even deleted one.
It wouldn't be so bad if it was just me, but having read the bad publicity they get, I am sadly not alone.
All those people who are so quick to defend them, let me tell you. This company doesn't deserve being defended they are a bad company and they urgently need a good kick of the rear.
But don't believe me use goggle there are plenty of posts about the terrible service.

Well,
I have just called Trading Standards in Ashford, (I started of, and the woman said is this to do with a 28" TV on Ebuyer, I said yes, she told me she had just put the phone down to some unhappy customer)
Basically, she advised me that we wouldn't really get too far. A judge would look at it and say "A 28" TV for £28. An obvious mistake. Then all the courts would do is look to put you right as to before the transaction. IE have you refunded accordingly. She did say that I can go for the sales tactic, IE they had them that cheap to lure people to use Ebuyer, but it would be difficult to prove.
Ho Hum,,,,,
I will leave it now I think, getting fed up with it........
