Regarding Samsung 28inch pure flat widescreen TV (quick find code 86649)
Please note that the above item has been incorrectly priced on our website and
under our Terms and
Conditions 2.3 which states,
Every effort is made to ensure that prices shown on the Supplier's website are
accurate at the time
you place your order. If an error is found, the Supplier will inform you as soon
as possible and
offer you the option of reconfirming your order at the correct price, or
cancelling your order. If
the Supplier does not receive an order confirmation within 14 days of informing
you of the error,
the order will be cancelled automatically. If you cancel the order, or if the
order is cancelled
automatically due to the expiry of the 14 day period, the Supplier will refund
or re-credit you for
any sum that has been paid by you or debited from your credit card for the
goods.
We will not be supplying this item. In this instance we have cancelled your
order and issued you a
refund, we apologise for any inconvenience this may have caused you.

With reference to your email below.
I understand that the price may well have been incorrect. Additionally, your
T&C's may well state that prices on your website may well be incorrect.
However, the fact remains that your company has taken money from my credit card account. This means that you have formed a contract to supply the item at the price originally agreed and debited from my credit card account. This is simple contract law and supercedes any T&C's you may choose to print on your website.
I see that you have refunded the money taken from my credit card account.
This is not what we have agreed; your company has decided to take this
action without my prior agreement.
I expect a response to this email by 12:00 Monday 14th March 2005. I also
expect a confirmation of the delivery of the television within 7 days of
this email.
Failure to comply with these actions within the timescales will force me to
pursue this matter though the legal process and also report your company to
both Trading Standards and the Advertising Standards Authority.

At the begining of this thread posts 3,4,5 very quickly worked out this price was a mistake.
If you all feel that Ebuyer is such a lousy company its simple don't purchase from them again and don't post any further items from ebuyer, In a law court I very much doubt if anyone that is a member of this forum could say under oath that the price quoted for the TV wasn't a misprice0 -
i dont buy from them, their customers service is the worst i come across., however with the outstanding unbelieveable( their words ) price of £28 for a tv i felt that even if it went wrong within a year, id just throw it away.I could even ebay it as defective, might get my money back lol0

well CRT's are soon to be obsolete, and maybe one would have assumed that eBuyer was clearing stock, espically when they word the offer as "unbeatable price".
As some have already suggested, why is it so hard to believe a TV can sell for 33quid from eBuyer? Have you not seen other products from eBuyer that are priced just as low?0 -

Just an update on my situation. The cables arrived today in an anonymous package delivered via Royal Mail. Dho!
Enoted ebuyer and they're refunding the postage so I'm happy with that.if i had known then what i know now0 -

That was me. And I have contacted Trading Standards about it already.
My tv arrived today and to add insult to injury I had to help the courier unload it and carry it to the front door as it was too heavy for him to lift, nor did he have a trolley (I'm female by the way, not saying that excuses me from lifting - but makes you wonder what would happen if I was a pensioner or had a bad back or something). Joke.
Doubt I'll get my £18 back, same as I doubt you guys will get anywhere with this, but I wish you luck all the same.0 -

A misprice or not doesn't come into it.
It's the fact they accepted our money and entered into a supposedly binding contract and then cancelled it.
Also what if the price was £1000 and 1000 people bought it,that's £1,000,000 they could keep for up to 3 days and collect all the interest on it.
Surely there's a law against that or every company would be doing it.0
