    Look it this way vinny41. Would you be happy to see a bargain in a shop, go to the checkout pay for the item, then the shopkeeper the approached you and said "sorry it was a pricing error, here is your money back". That is what has happened to us, accept they kept our money a little longer and then lied that this item is discountued.

    Perhaps if more people fought for what is they believe is wrong companies wouldn't try more to not make mistakes.

    I am sure most of us would have given up by now if a contract had in fact not been breached.

    Dear Sir,

    Thank you for your enquiry regarding EBuyer (UK) Ltd and their cancellation of contract for the supply of goods. The company contacted this service on Monday 7th March alleging that the price of a Samsung 28" widescreen TV had been advertised on their website, incorrectly priced at £28.08 (excl VAT).

    It appears that many customers have responded to this offer and Ebuyer, in realising their error have notified all potential purchasers of the intention to withdraw from the contract. There are a number of issues which arise from this situation, not least, the companies contractual obligations, where the customer maintains that a legally binding contract exists. Sheffield Trading Standards are awaiting further information from the company and intend to meet with representatives to clarify matters.

    The current position is that the company appears to have formed a number of contracts for the supply of this item but will not be in a position to supply the goods at the advertised price. The remit of trading standards is to consider whether the company's actions constitute a breach of trading standards legislation. As 'the customer' you must consider the feasibility of enforcing the contract. A claim for loss of bargain at the county court, whilst possible, is problematic. You would need to demonstrate that due to the company's breach of contract, you had subsequently acquired the goods elsewhere at a higher price. The price difference would then be the basis of your claim.

    As with any litigation, there are risks. You are required to demonstrate that a contract existed, that the seller was in breach of that contract, resulting in losses to yourself. Were the company to defend a claim, it is likely they would raise detailed argument regarding this and whether it was reasonable for a potential purchaser to rely on what appears to be a very unrealistic price.

    As previously stated, arrangements have been made to discuss a number of issues with the company in the near future. The response to your enquiry does not constitute definitive legal advice and were you to consider pursuing the matter, it may be necessary for you to consult a solicitor.

    Complaint details will be referred to Sheffield Trading Standards for consideration and responded to where appropriate.

    I rang Trading Standards yesterday but it was on answer phone. I left a message for them to get back. I aint giving up. I got the usually got and paste job from Ebuyer which the sent me the previous day. They maintain it was obvious pricing error and that no contract was formed, despite them debiting my CC.

    I have reported Ebuyer to Advertising Standards Authority on another matter.

    They are shoddy, they are liars and they twist and manipulate there own terms and conditions in favour of themselves.

    Well has anyone followed the posters advice re loss of bargain - there seems to be an awful lot of "chuntering" going on with no one actually getting off there !!!!!! and doing anything - you can write all the letters you like but you aint getting anything till you actually go and purchase the exact same model and then you claim for loss of bargain - the only alternative is to go down the breach of contract route and that will cost you thousands...I know Ive been there!

    the law is stupid in this way, it obviously should be the other way round, you win some ruling saying you could buy the tv at full price and get refunded the difference. But life can't be that simple :)

    reduced to ONLY £300 now on the website, i wonder if you had oredered it £330 they would have said, sorry a price mistake - here have £30 off your tv. i doubt it.
