I collected a number of penalty charges for going over the limit when I first had the account about three years ago. I only did it once, in fact (by accident), but the mighty Egg computer worked out the repayment amounts without reference to the shortly-to-be-applied charge, thus taking me over the limit and ensuring the same thing happened the following month...
I didn't pick this up for ages, since I had stopped using the card, but when I found out, I complained, both on the grounds that their computer wasn't calculating the correct minimum amount to bring the account below the limit once the previous month's penalty had been applied, and because they were charging £16 a time.
I got no joy from them then, and when they cancelled the card (as they did for many customers) I just left it. A couple of months ago, I had to cancel the direct debit through lack of funds and of course, they slapped another £16 on and I came here! I'm still short of funds, and their attitude re penalties (discussed with you in a few posts above) made me wonder if the accumulation of disputable penalties in the gross amount might make it more difficult for them to pursue me through the courts. I don't care about credit ratings, as I'd rather not have any credit anyway!
That's a brief summary, anyway. If there's anything else you need to know, please advise. I do appreciate your help.0 -
With Egg you may have to go all the way with them on the £16 ones but you can claim interest on the charges as well. If they took you to court then you have a counterclaim for charges as well. so it's all good.0

Can county courts order payment arrangements, eg. so much a month for a fixed period? Arrangements made directly with the companies themselves are likely to go on forever, I imagine...0

I have bought a little time with Egg, who allow reduced, fixed payments for up to 6 months, but I would still like to know what options are open to the county court, if the case ends up there. Can the judge effectively cap the amount owed by ordering payments for a set period, or is a CCJ only ever for the full amount?0

I've only threatened to, so far (to reclaim charges). Because of financial constraints here, I cancelled their direct debit, so they weren't paid for a couple of months (I'm paying off a £2k balance rather slowly) and they have made noises about taking me to court. I've bought a stay of execution, but was asking what powers a CC judge would have WRT settlement, if they went that far.0

I have written to them twice now, first to claim £208 (plus 35 quid interest) on £16 over limit charges, then to offer to take just the £208 and forget the interest. Both times they have written back refusing to budge, saying their charges were fair.
Is it best to now take them to court or go to the FOS? Either way it will be charges plus interest....0 -
In addition to reclaiming my charges from my bank accounts - I am also attempting to reclaim them from my 2 credit cards - Egg and Capital One.
Is anyone else reclaiming from credit cards? If so how have you got on?
I have requested £120 be paid back to me from Egg. They responded incredibly quick (in just 3 days) saying that they will not repay the charges and that if I continue to pester them they will close my account and will demand that I repay them the £800 that I owe within 30 days...
Have any of you been successful with Egg or other credit cards?
There is no way that I could come up with £800 in 30 days - should I just drop this one? I do not think that i am brave enough to continue this fight...
I was thinking - if I won my Natwest claim (of £775) I could settle my Egg card and then re-take up the claim for £120 - as they wouldnt have anything to threaten me with then - would they?

Has anybody had any success with Egg recently?
I found that claiming back charges from other companies to be a straighforward process but Egg have been very stubborn and have refused to refund nothing after 4 letters threatening them further action. I've now made a complaint to the FOS and hopefully I can get a positive result that way0
