it's 10% you could have had yourself ;).
    However, great win nonetheless.

  • I sent the standard letter (just asking for a list of charges) from this site to Egg on 18th February, along with my cheque for £10. By the start of May I had heard nothing from them so I called them up to ask what was going on.

I was told that they only had 40 days to respond *from the time they cashed my cheque* and that they were very busy dealing with a backlog of these requests (my cheque has not been paid in yet). So I said to them, "Basically you can then take as long as you want, and the 40 days is meaningless?" and they didn't deny this.

Are they allowed to do this? Has anyone dealt with Egg recently and if so, how long did it take to get info out of them?

I gave them 54 days and then called the Customer Relations Department on 08007 834 393. The girl I spoke to told me of the delays, said they were returning cheques as a result but if I only wanted copy staements she could reprint them and send them to me. This was on Friday of the last bank holiday weekend and I had them by the following Wednesday. Give it a try - good luck

Egg are still insisting that their £16 penalty charge is lawful and they say it has been confirmed by the OFT. To quote their last message to me: "They've found that our charges are lawful."

Naturally, they didn't include a reference, so I have asked for chapter and verse, but I can't believe I'm the only person who has been fed this line. Has anyone here been through this?

Apologies if it's on the forum, but I did try a couple of searches...

    Thanks.

I love this one. Ask them what OFT842 says on point 1.14 with regards to private claims through the courts and UTCCR 1999. OFT842 does give them their £16 but it doesn't state that because they say this that it is fair. ONLY a court can decide a fair charge.

Thank you - just what I was looking for!

As a matter of interest, since I imagine they won't budge unless/until I threaten court action, what is the position if I force them to take me to court? Is it any defence (for withholding payment) that they are themselves failing to obey the law - in this case, UTCCR 1999?

They aren't failing to uphold the law, they are being obstructive to you trying to reclaim unlawful charges. After all, they won't be able to refer to the OFT report in a court of law.
It might be worth adding to any final letter the words, "to avoid further legal costs on your part, I would consider settling my claim for £xx.xx providing I receive your offer by x date".
    Then sue them.
