Over a year ago (yes back in April 2007) I worte to Egg with a subject access request. I did the usual letter, (from CAG at the time) and they wrote back to me telling me to get lost, in their usual fluffy language.
I am now going to start claiming again. As per Martins second letter, proceedings before court action. I can't provide a specific date. So do I
a) start again from the top, potentially loosing some ££ because the charges will have dropped off by now, if you know what I mean.
b) Just put an approximate date in the letter and go forward with a claim ?

Date for what exactly?
As a rule, don't use approximate anything in a claim. Did you get the data in the end, and did you send the £10? If you sent the SAR along with the £10, then they are in breach of S.7 DPA. You demand that they send all data (thats everything they have on file about you, not just statements or a list of charges) within then next 14 days or you will take them to court to force disclosure together with damages.
Once you have the data, claim for all the charges, even those that are older than 6 years. You can use a certain clause in the Statute of Limitations Act to claim them more about that here.
They might try to argue against it, but first they would have to go into court and prove that their charges are legal, and so far no credit card has dared to attempt to do that..0 -

my question?
I have been charged further charges since sending my letters to egg in the complaints form to Ombudsman should i include them with upto date interest? ie calculate all interest again?0 -
Yes include them and redo the interest on all your charges using the Interest Calculator.0

Hi I need some advice - sorry it's a bit long winded.
I recently noticed egg had put a £16 over limit charge on my account in Feb.
I hadn't noticed as my card WAS set to pay off the full amount every month by direct debit.
I looked through my statements online and noticed I had the same again in September 07.
I emailed and complained and asked for the money back.
No joy, so I asked to close my accounts and I was happy to leave it at that.
I sent full payment for the amounts showing, and expected to hear nothing back.
They then put another £16 over limit charge for being £10 over the limit this month!
I phoned them today and complained bitterly saying the only reason I was over the limit was because of the previous £16 charge.
They told me I had to pay it or they would refer it to a debt collection agency (((for £16!)))
So - I came here and read a lot of what is here.
My questions are:
Should I pay off the £16 outstanding then try to reclaim £48 or should I just refuse to pay it?
I'm also worried most people here are claiming huge amounts - is it worth it for my £48?!?!0 -
I asked for my cc charges from egg in feb 2007. They sent me a letter on 12 feb 2007 saying that theh charges were legal and why and said 'You now have six months from the date of our resolution to take your complaint to the Financial Ombudsman Service...'

I am one of those who recently got stung by egg when they increased my APR on the egg card by around 10%.
Sadly I am one of those who make minimum payment each month by Direct Debit on the 1st of each month (about £90). A few months ago I used my card to pay for fuel at one of those automated petrol stations. When they added the interest in the middle of the month I was about £6 over my limit. Consequently they fined me £16.
i did not notice this until the following month when they took the minimum payment again. i never used my card again but again, in the middle of the month, the added the interest again and once more I was fined for being over the limit.
i wrote many emails to them but I got the response about terms and conditions etc. When I challenged them on this they told that the OFT report in Apr 06 said their charges were legal! This was not my take on their report. They also told me that on my on line statement it tells me how much interest is due to go on my account, I still, to this date cannot see where it says how much interest will be added, all I can see is what they intend to take as minimum payment.
Is it still worth while trying to reclaim from them? Can i still do this even though I live in Northern Ireland?0 -
Send off the first letter and as you can see from the above posts it will probably take a second letter at least to get a result.0

Would just like to thank Martin and all MoneySavers for the help and advice which has led to a mini victory.
I had just over £700 of charges including interest on an old Egg credit card so I hit them with Martins letter. They denied they were unfair but offered me £108 - what a laugh, so I went via the FOS (Financial Ombudsman Service) and recently received confirmation that Egg would rather pay me the charges in full £520 plus a proportion of interest (almost all of it) of £169 rather than be investigated by FOS, so I am now waiting for my cheque for £689 - Woooo !
So let that be a lesson to anyone who is thinking of not pursuing a claim - Get it sorted and get that money back !
