  • Hi guys, I was unable to find a post on the recent fine levied by the The Financial Services Authority to GE Money for payment protection insurance (PPI) sales breaches.

Has anyone yet claimed for this? As I never agreed to the PPI and have started to write to GE Money, I have since stopped this payment on my Topman Account card managed by GE Money...does any one have more on this?

    Thank you

Hello, I am new at posting on the site but have been logging on every day to keep up with current info on the site!
    However i have a question-
I have recently sent off my subject access request to GE money on behalf of a House Of Fraser account(very stupid i know!) and got nowhere fast so was having to ring every week to chase them up, i finally got a letter today listing my charges but no statements to accompany them, i know on the letter template that i am asking for copies of my charges so are they within their rights just to send me a peice of paper listing my charges..?
Its just that there is only £120 worth of charges on there and i am positive i have more..
and they were charging me £15 a time ..
funny thing is i received a letter on fri saying they were reducing "admin" costs from £15 to £12! still want my money back!
I had no problems with Halifax asked for £791 and accepted £700 in 3 weeks !

They dont have to send statements and, depending on how your request for information was worded, would charge you if you asked for them. My personal response would be to reiterate the request worded thus:

"I have received partial reply to my request for details of default charges applied to the account. As this information is clearly incomplete and inadequate I have no alternative but to assume you have misunderstood my initial request. For your convenience I will further clarify my initial request. (this bit does not acknowledge any mistake you may have made in the wording of your first request and technically adds to it, without the need for a second request incurring a further charge of £10, if applicable, sneaky eh ? )

I require complete, fully legible and comprehensive details of all default charges applied to my account for the past 6 years as is my entitlement under the Data Protection Act.

Please note that I am advised it may be practice for some financial institutions to store older records and that the Information Commissioner has deemed microfiche to be a relevant filing system under the the Data Protection Act. As such, any of my data stored in such a manner must accordingly be represented in a fully legible and comprehensible form in accordance with my entitlement and not sent to me as microfiche. I do not anticipate any deliberate obstruction to my request regarding this issue, should it arise. (just in case they try this one)

You are obliged under the Data Protection Act to respond to my initial request fully within 40 days and I require response within (however many days there *should* be left from the date you sent in the first request, this is technically the same request.) "

As I say that would be my personal response, you may not wish to use it or use it and edit it but I hope it helps in some way.

    Good luck :)

    Hey guys,

I have been trying to find any tips etc regarding the Topshop Store Card but to no avail.

I sent off the DPA statement request letter and have had no word back. I haven't used the company since 2001 and am wondering whether they are using this as an excuse to stall.

I will call them tomorrow to see if they received the letter.

    Hi natkessa

You say that you haven't used them since 2001, please remember you can only claim for the last six years charges.

If you have had charges in the last six years, by all means chase them up on your DPA request.

    Regards

  • Hi All.

I have a Debenhams store card run by G.E Money. I rang the Debenhams customer service and they rang me back within 2 days giving me a list of my charges (there were only about 5) over the phone meaning I got the info quickly and without a £10 fee.

I sent off the template letters included 8% interest (£147.86) and got a nice letter back saying they will pay in full crediting my card and then sending the excess by cheque. This was all done in less than a month.

Go for it! What are you waiting for.

    Ed.

    Hi all,

i requested statements on 6 feb and they cashed my chq a week later.
I called today as it is 41st day since sending and would see what was happening as including time for sending they only have a couple of days left. I called customer services twice:

First time the guy found my acc and then tried to refer me to the debt agency. I advised him what i was looking for and he said he could not help but would speak to his manager. I went on hold and 10secs later got cut-off

Second call advised him i was looking for last 5 years of charges said he could not help me as acc was with debt agency. i asked could i speak to DPA dept, he said that i would have to speak to Debt agency.

Called debt agency as i predicted they could not help.

Third call same number a message said to call another number, called this number to be told it was insurance but gave me the switchboard number down south. I said straight away i was looking to speak to complaints dep or dpa or manager with regards to store cards person put me through and the person said it was dealt with on 17/03 and i should hear shortly.

Sorry i went on but it looks like the customer service dep has no idea of what they are doing and just try to fob you off.

PLEASE USE THIS NUMBER 0113 207 5269 AND SAY YOU ARE LOOKING TO SPEAK TO THE COMPLAINTS DEP OR MANAGER OF THE DPA DEP.

Hope this helps as i feel this company may be pretty useless

I've just received a letter from the GM card (HFC bank) in response to my letter requesting funds back, that they will not be refunding any charges as they have "carefully considered OFT's publication and does not accept it's findings" No REFUND then. Should I sent them the next letter now giving them 7 days and I will proceed with filing a small claim????

Another question.... Is the OFT's ruling apply to Credit card banks/companies the same as Banks ?????

Send the Letter Before Action giving them 14 days. Ignore their opinions on the OFT ruling, it does apply to credit cards, but does not dictate the law.
  • when they are given 40 days to respond, is that working days or calender days?
