Wait, wait, wait. So if, for example, I took out a contact with Three, tried the phone out with an old sim, decided I didn't like and voided the DSR, I could say I was sending it back, "lose" it, sell it abroad and get out of my contact just by paying for the phone??

I suppose in theory you could do that but what would be the point you are still going to be liable for the cost of a new phone ...so unless you sold it for a lot more than market value whats the point ???It's not just about the money0 -

Exactly, I am happy to pay for the phone because it was my mistake not keeping better hold of the post office number.
The jiffy bag was sent to me prepaid and preaddressed. I just took it to the Post office and said can I send this, they did scan it and give me a reciept I still may find it0 -

Pop back to the post office in question and ask if they have a record of the item.
3 themselves might have a tracking reference on their systems, you just need to get through to someone who can trace back the trail - because they can check with post office.
If they do not find it, 3 will want the early termination fee for cancellation of contract - not the cost of the phone.0 -

It is not cancelled till they get the phone back in their hands (even under DSR).
What I have tried time and again is to get the OP to chase up the delivery people and 3 - because he/she will need proof of sending the phone back (if it is lost) to get out of paying for the whole contract line rental.
A request under DSR can be made within 7/14 days, upon receipt of the phone back in the correct fashion, that request is fulfilled and contract cancelled. If that does not happen, the contract continues.
If you do not agree with that opinion and you do not - stop repeating it and telling what I can or can't say on here.
If you do not comprehend that, then you are simply delusional and giving false hope of buying out a contract by paying for a phone.0 -

For the umpteenth time it is cancelled ..in fact it was never concluded because the airtime wasn't activated.It is not cancelled till they get the phone back in their hands (even under DSR).
The OP asked to cancel under DSR's and they accepted by giving returns details and packaging ....the contract is "outstanding" untill the phone is returned or paid for.
The contract is for airtime service not a phone

Geez - what is it with you that you do not understand I am saying to you?
The OP asked for the phone to be canceled under DSR - that is not immediate - it requires the item to be sent back.
The next step is the OP gets a packaging to return the item.
Upon return of the phone - the network or retailer will action the cancelation request providing the phone is returned in the condition stated in the terms and conditions of purchase of a mobile contract service.
That has not happned - clearly not happened because the OP is getting billed 2 months down the line. Can you understand this important bit. 3 have not canceled the contract. Whether it is through a billing process error or that they have not acknowledged receipt of the phone back - that is the problem.
If 3 say they got the phone - the OP has nothing to pay for - no line rental to pay for and certainly no phone (as it IS NOT the phone that is purchased).
If 3 say they did not get the phone back, then it is down the OP to prove that the phone is lost in transit. And for that the OP needs a tracking reference or some help from the delivery people and 3.0
