But you still pay the going rate for the phone such as the price of a PAYG one from 3 ...so why wouldn't the OP just buy a PAYG ....theres no advantage

Been away this weekend and surprised this is still current.
2 Things. The bit I quoted some time ago covers this situation. 3's t&c state that they will charge for any missing bits that they don't get back if a phone is returned under their 14 day returns policy. No doubt it was there to cover missing charger or handbook, but there is nothing there that excludes the handset. I believe that there is sufficient in these t&c to allow the contract to be cancelled, subject to charge.
If OneaDay is willing to accept the premise that the charger or handbook is covered by this section, then I honestly don't see how OneADay concludes that it doesn't apply to the handset.
If on the other hand, he thinks it does not apply to the charger, then what doe he think it does cover?
However, the OP may be being a little naive on another matter. OP wrote

If OP thinks all they would have to repay is £12, then think again and look at PAYG prices for the handset, as that is what it would cost, I suspect.

I know its was wishful thinking to only pay 12 for the phone, that was just because the contract was a quid a month more than SIM only plan.
My latest update is I have written to head office, tried everything. There is no point talking on the phone any more literally spent hours and going round in circles.
Have decided to leave it now and see what happens. I have offered many time to pay for the phone if its still doesnt turn up and any fee`s, but not for the contract which I cancelled within the alloted timeframe.0
