    No I will not toddle off anywhere and I am not an idiot as you put it.

    And what I think or say about mobiles.co.uk is based upon my own experience of having used their services (3 contract phones), not merely encountered them once (like you) and left a chip on your shoulder because you could not deal with returning a phone.

    Just a note to those who said I did not send it back, it was a rubbish old blackberry not a new smart phone. Surely I would have done a better phone. The contract was only 1quid more than a SIM only plan. So 12quid is all I would have paid for the phone over the contract.


    Be nice if 3 would charge me 12quid for the lost phone. If it was lost that is, I suspect they do not mark an item received until someone proves they sent it.

    All I can prove is that I was given a returns authorisation number and I requested the contract be cancelled as soon as it arrived.

    I think its perfectly reasonable for me to just pay the cost of the phone but not be charged for these 2 months contract, especially as its obvious the SIM was never even activated and has never been used. I confirmed this on the phone.

    My worry is they are still viewing it as if the contract is still running and I am trapped I have no idea how to stop it! I have asked repeatedly please please can I just pay for the phone and any fee`s OK fair enough, but if I pay for these 2 months line rental then I am agreeing that the contract has started, I don`t agree I say the contract never started because the SIM was never activated and I have a returns authorisation number. I would do anything to find the post office receipt with tracking number I know its entirely my fault for not keeping it safe.

    I am doing everything I can but 3 is the worst network and the worst service I have ever delt with in my life. What on Earth can I do now? Soon I will owe them another months line rental AHHHHHHHHH!


    Last person I talked to at the 3 call centre was a little more helpful to start with (so I thought) it took me the usual time to go through everything yet again. I asked her can you please help me I will pay for the phone if it still has not turned up, but please stop billing me every month the SIM was never activated. I asked her what are my options? She said 1. you could transfer the account to someone else or 2. pay the penalty fee which is the remainder of the contract. Yes very helpful.


    My 3rd option is just ignor the red letter`s and not care about bad credit rating, I really do not want to do this because it will affect me for a couple of years. But option number 3 is better than option 1 or 2.

    Do I have any other options?

    My opinion (if anyone wants to listen), the contract cannot be paid off by paying for the mobile. Cancellation requires the phone with original contents and packaging to be sent back.

    That said - I did some googling and found some article where there was a case of someone having returned a phone on a contract (with 3) within 14 days to 3 but still getting billed 2 months later. It apparently was due to a billing issue with 3. That could be the case with your problem.

    Now if you say you returned it - the problem is simply that of proving it was returned through having the return tracking number. If you had that, you could sleep easy.

    In a similar situation to you, my first port of call would be 3 in the UK offices (through their complaints department) to escalate their search for the phone and confirm they got it and the contract is cancelled (and the extra bills are error on their part).

    I would also be onto to the delivery people to ask them to check their systems for you (by name/address) to get that tracking number so that you can tell 3 what that tracking number is.

    Hi Ponyo,
    Your welcome,
    First of all do not pay any line rental because thats going to delay matters.

    You need to write to 3's head office and point out that they are currently charging you for a contract that was cancelled by both you and them under DSR's

    Point out in the letter the situation up to now and say that if they are unable to locate the missing phone that you are quite happy once all avenues have been exhausted to offer payment equivelent to the market value in order to draw the matter to a final conclusion.

    Make sure this time that you send this recorded or via email so that you have some form of durable media to cover yourself. Do not use phone or website contact anymore.

    Meanwhile you need to satisfy yourself that you have done everything at your end to locate the phone or despatch receipt.

    Bear in mind that untill they invoice you correctly for the outstanding amount they are going to claim, they will be unable to enforce payment.

    Keep us posted what happens ;)
