Got to fully disagree with Quidco regarding this bit:
"I am sorry that you have been given this information by the retailer, who have misinformed you. All cashback offered on our site is offered directly by our listed retailers and is processed by any affiliate network that work on their behalf.

All cashback offered on the Quidco cashback site is offered by Quidco, it's Quidco who are saying, "We'll give you cashback if you purchase via our site".

In what you have received from Quidco, then go back to the FOS and advise them that L&G haven't paid out a promotion advertised stating cashback would be paid if taking out one of their products. Go back to L&G and tell them they haven't paid out on an Affiliate marketing promotion.

    Good luck,

    Good morning,

@jintyb – In all cases the cashback will come direct from the merchant, and we then pass this on to you. Some merchants do request we put this warning on their page so that they do not receive queries relating to cashback, as they cannot advise on this. As soon as the cashback does come through from the merchant we can then pass this on to you, but unfortunately we cannot do this if we have not received it ourselves; this is just how the affiliate system works. Please don't think that we aren't acting on this, though. Our payments team are working extremely hard to resolve all delayed payments and we are making a lot of progress. However as I have stated previously, we can never guarantee how long cashback will take to come through, we can only provide an estimate.

@shaftingham – All click throughs that you make are recorded, however this is nothing to do with the actual tracking of the purchase. If you do not have the correct settings applied to your browser and security software then this can block the access of the affiliate networks, so your purchases may not track. Also please do be aware that we do not track the purchases ourselves, we don’t have anything to do with the actual tracking so we can only advise you of the appropriate steps to take to ensure your purchases do track. In regards to Casinos, please do be assured that this isn’t the case at all! We certainly wouldn’t let this happen. The casinos and gambling sites on Quidco do pay out a huge amount of cashback to our members, many of whom have won (they do come back to us frequently to advise us of this!).

@Sarahf – Can you confirm whether your purchase tracked in naturally or whether you had to raise a claim? The average payment time for Vodafone is 2 months, however it can sometimes take longer than this. Please see the breakdown of payment times on their Quidco page:

    "Payment speed

    Less than 2 months

    (from tracking date)
    80% paid within 60 days
    14% paid between 60 to 90 days
    6% paid between 90 to 180 days"

    Kind regards,

    Rosie

Thank you for taking the time to reply, and I am sorry to labour the point, but it clearly states in the T&Cs on the L&G Over 50s offer page that the cashback is paid directly from Quidco not L&G.
What part of that am I not understanding? I bought the policy, didnt cancel with three months, waited over 180 days before chasing the payment, in short stuck to my part of the bargain and yet I have not been paid.

You are understanding perfectly correctly...........maybe time for some training/upskilling at HQ??

There is no way that L&G are saying, "Buy our product via Quidco and we'll pay YOU cashback".

Members of Quidco deal with Quidco.

Quidco deals with the Affilliate Network.

    Affiliate Network deals with merchant.

There could be agents/agencies in between.

There is no direct link between member and merchant regarding the cashback promotion other than purchasing the product. The "enticement" is offered by the cashback site.

    Hi,

@jintyb - The cashback is paid to us from Legal & General which we subsequently pass on, and Quidco cannot pay on the cashback until we receive it. I do understand what you are saying, though, and this term does need to be clearer. The terms and conditions are written by the retailer as opposed to Quidco, so we are going to go back to them to see if this can be worded in a better way.

Cashback will never be paid to you directly from the retailer, which is what this statement is supposed to suggest. Once we have received the cashback from the retailer, the cashback is then passed onto you via Quidco. I hope this makes matters clear for you.

    Kind regards,

    Rosie

I appreciate your answer and thank you.
My perception of the T&C's are that if they appear on Quidco's web page then they are Quidco's T&C's and put there by them!
If I wanted to be bound by the retailers T&C's then why would I bother going to them via your site?
I think it's fair to suppose that if I go on to a retailers page within Quidco, read the terms and conds and then make an informed decision to purchase , then they are the T&C's I'm bound by? I cannot understand why you are now saying that the retailer is responsible for the content and it's nothing to do with you!
I have placed my business via you therefore I expect you to be responsible for what you publish on your website. I dont think that is unreasonable!

    Good morning,

@jintyb – The terms and conditions on the Quidco page are in regards to the cashback available, as opposed to the full terms and conditions on the retailer's own site. The cashback terms and conditions are still provided to us by the retailer, though, as the cashback is coming from them, and there may be certain parts of the offer that cashback is not payable on.

For example; if you were to take out a mobile phone contract with a particular retailer, it may be stated under the terms and conditions on their Quidco page that you have to be a new customer. This is a condition to receive cashback, you can of course be an existing member if you just want to take out a phone contract without the cashback. However, the retailer may state under their own terms and conditions that you cannot cancel the contract for say, 12 months. This is part of their own terms and conditions and most likely won't be stated on their Quidco page. I hope this makes it a bit clearer for you!

@Sarahf – In this case we would be expecting the cashback to come through very soon, as Vodafone do usually pay out very quickly. Although 2 months is the average payment time, it may take slightly longer to come through on occasion, as shown in the statistics.

    Have a great weekend everyone.

    Kind regards,

    Rosie
