He still has all his paperwork so that'll be a job for me to do next week. I was thinking of copying the conflicting evidence they have on their site and what information he already has, and sending it to them. They can't argue with that. I'll also keep copies of everything I send.

I don't know why they think they can get away with this. They actually texted him after they'd received his bill, saying that he'd get his cheque within 30 days.

Personally I would wait until the end of the 12 month minimum term in case any more problems crop up, then send them an invoice for everything they owe you, give them 14 days to pay or you'll send the boys round.
  • I had a similar experience. Purchased my phone on August 31st, phone arrived on 1st September. I sent in my 4th Bill received in December and got a rejection saying that I should have sent in November's bill as that is what the cashback table stated. However, their website stated that I should send in my December bill.

I sent a letter to the appeals department on Wednesday showing screenshots of this in addition to showing that I was not connected to my contract until 1st September. By lunch time on Thursday I had received a text saying that my cheque had now been raised.

It's definitely worth appealing if you've been in a similar situation

I would also like to know if anyone has taken the matter as far as the Small Claims Court (allthough it does cost £30 to register the case online).

I have also contacted Trading Standards (Loughborough), Money Mail and BBC Watchdog.

I'd be interested in reports on how far people have had to go, and if they needed the SCC. I'm still livid with these con artists. I really don't understand how they can been so blatantly illegal at a consistant rate.

Don't worry just be very firm and persistent.

I had no joy whatsoever when phoning e2Save but within 24Hrs of sending a letter (regsitered) I copied the same to the carphonewarehouse (by letter and email) and my phone company, Virgin (by email).

Within a matter of hours I was phoned by both and the matter was resolved.

Like I said earlier, they are aware of the contradictory info they have provided, so it is just a case of sticking to your guns.

For those taking this to the small claims court dont forget to add the £30 fee to the amount claimed.

Check the text, I think U will find that it is only an acknowledgement of receipt.

I had 2 txt from them. First one said they had received my bill etc. Second one (sent a few hours later) said my claim had been successful.
